HomeMy WebLinkAbout11-22-3820 Council dinutes Pulaski, Va.; November r;2, 1938 The Council of the Town of Pulaski met in special meeting at 7:30 otclock P. M., at the Mayorts office, pursuant to a call made at the last regular meeting held on November 15, 1938. There were present: Acting -mayor A. T. Eskridge, presiding, Lottie R. Runion, Clerk, and Councilmen: L. E. Whitesell, G. C. Hall, F. A. Seagle, T. L. James, A. 2J. Bushong. Absent: Councilmen T. J. Wallner and J. E. Bunts. The approval o.' the minutes of the last regular meeting was deferred to the next regular meeting of the Council. At this special meeting of the Council, came the County School Board, Pulaski County, and presented its petition asking for the discontinuance and vacation of a certain alley running East and West through Block No. 2, as shown on the official map of the Town of Pulaski, Virginia, and which alley is bounded on the North by Lots 29 to 51 both inclusive, and on the South by Lots 28 to 50, both inclusive, and said alley being twenty (20) feet in width. And it appearing that notice of this application was duly posted on the first day of November term of the Circuit Court of Pulaski ,County, to -writ -November 14, 19382 in front of the Court House of said County, and at two other public places in the neighborhood, at least five (5) days prior to this said application, as authorized by sections 5220 and 2039(9) of the Code of Virginia. Upon motion duly, made,and seconded, the Acting -mayor and all members of the Council present concurring, it was ordered that Dr. '�;. S. Gilmer, C. L. Plunkett, Howard C. Gilmer, Sr., E. P. Bunts and B. Laughon, citizens and freeholders of the Town of Pulaski, any three of whom may act, be and they are hereby appointed commissioners and viewers, who shall view the alley proposed to be discon- tinued and abandoned, and report in writing to the next (cont) 1 Council Minutes Cont. Pulaski, Va., Nov. 22, 1938 regular meeting of the Council of the Town of Pulaski, whether in their opinion, any, and if any, what incon- venience would result to any person whatsoever in discontinuing and vacating said alley. • And,it is further ordered by said Council that the Clerk give due notice to all persons owning real estate abutting on said alley, of the report of said Viewers and of the proposed action of the Council of the Town of Pulaski prior to the next regular meeting of said Council, in accordance with the statutes heretofore referred to. TO THE COUNCIL OF THE TOIFJN OF' PULASKI, VIRGINIA: The application of the Country- School Board of Pulaski County for the discontinuance and vacation of a certain alley running East and through block No. 2, as shown on the official map of the Town of Pulaski, Virginia, and which alley is bounded on the E orth by Lots 29 to 51, inclusive, and on the SOutI1 by Lots 28 to 50, inclusive, in said Block, as whown on the official reap, and in which the undersigned County School Board of Pulaski County would respectfully show unto Your Honorable Body: (1) That said alley was set up and established by a certain plat with certificate of the Pulaski Land and Improvement Company filed for record in the Clerk's Office (cont) 21 I 22 Council idinutes Cont, Pulaski, Va. Nov. 22, 1938 of the Circuit Court of Pulaski County, Virginia, in Deed Book 15, page 3, said plat being generally known as "Corrected Plan ATT of the Pulaski Lund and Improvement CompELny; and., (2) That said alley has never been actually opened and used by any persons, nor the dedication aforesaid officially accepted; and, (3) On the contrary, the property through which the said alley runs has always been treated as a full tract or parcel of land, being heretofore owned by Pulaski Horse Show Association, Incorporated, and others, who have treated said alley as a portion of the tract or parcel of land then owned by them; and, (4) No inconvenience will result to any persons whatsoever by virture of discontinuing or vacating said alley, inasmuch as the undersigned County School Board of Pulaski County is the ocaner in fee simple of the real estate situate both on the North and South thereof with the sole exception of a small portion of the real estate to the South of said alley; which is served by certain other alleys running through Block No. 2 aforesaid; and, (5) That the undersigned has had posted on the the first day of November Tera of the Circuit Court of Pulaski County, Virginia, to -wit: the 14th clay of November, 1938, at the front door of the Courthouse of Pulaski County and at two other public places in the neig}lborhood, notice of this said application, a copy of which is herewith filed and made a part hereof'. Whereppon, it is the prayer of the undersigned County School Board of Pulaski County that under and by virtue of Sections 5220 and 2039(9) of the Code of Virginia that not less than three nor more titan five viewers be appointed and designated to view said alley and report in writing whether, in their opinion, any, and if any, what inconvenience would result to any person whatsoever in discontinuing and vacating the same; and that upon sdid (cont) ii 1 23 Council idinutes Cont. Nov. 22, 1938 report and other evidence, if any, after notice to any of the oviners of reel estate along said alley proposed to be discontinued, said alley be discontinued and vaca-ted in accordance with the law in such cases wade and provided.
