Neblett - Aye Mary Lou Copenhaver - Aye As there were no further comments from the public, Mayor .Hancock .called for Council Committee reports. UTILITIES COMMITTEE Chairman Johnston advised that committee .had met February 29th and reviewed several requests for sewer connections and/or extensions primarily in the Dora Highway area.Council is presently in the process of upgrading the ordinance for sewer and .water connections and committee felt they needed additional .facts and figures before dealing with a lot of the sewer connections. Chairman Johnston pro- posed that Council postpone these discussions in terms of requests that had been .made. PEPPERS Chairman Johnston stated that-one shaft at pump station .had been dismantled and FERRY put .back together. Studies and tests .have been run, however, the Town .has not received results of these tests. They are also still experiencing a vibration problem. Councilmembers expressed concern over the responsibility of this problem and Town Attorney and Town Manager were requested to stay abreast of the situation.Performance bond and .warranties are still intact. It is hoped that Peppers Ferry will .take action. Mr. Terwilliger will try to find out how long it will be before we will .have some final resolution of this problem by .way of report, etc. and so advise Peppers Ferry that we expect them to abide by the schedule and if they don't, we .may .have to .take other, more drastic action. FILTER PLT Chairman Johnston advised that the Town had been notified by the State .Water Control Board, Department of Health, that we .f ailed to submit .sample for herbicide and pesticide testing in 1987. This .failure to submit .was a communication problem. We are in the processof drafting notice to our customers which will go out in the near future. Problem .has been corrected. Mr. McKeever advised that by June, 1988, another notification to our customers would .have to be .made in that our system is built with .galvanized steel and .has lead joints. This notification is .mandatory. PEAK CREEK Chairman Johnston stated that bids .have been let on Peak Creek Cleaning. CLEANING Mr. McKeever advised that when specifications advertised, it .was split into four items. 1) Sproules Run from corporate limits to Rt. 99; 2) from Rt. 99 to Peak Creek; 3) Peak Creek from Sproules Run to old corporate limits; and 4) from the old corporate limit tb,past the sewage treatment plant. Only one contractor bid on all four items. Simpson Construction offered an alternate bid on item 2. .Rather than clean the existing creek, they proposed that we rechannel the creek as it would be cheaper to rechannel than to try to clean the existing creek. It requires an Army Cofps of Engineer-Water Control Board approval to .relocate the creek channel. ~.~.~..The..~init.ation ofi. the project .may be .delayed if contractor .wants to do this project first because of the permitting requirements. We.will proceed to get the permits if .necessary and inform Mr. .Jake Blevins of our plans. Councilman Graham .requested a tour be made of the projects that .had been reviewed in the Utilities Committee .meeting. PUBLIC & PERSONNEL RELATIONS, NOMINATING COMMITTEE Chairman Neblett .had no .report. PUB~.IC OPERATIONS COMMITTEE Chairman Neighbors .had no .report. FIN~TCE COMMITTEE Chairman Crawford .had no report. ORDINANCE COMMITTEE Chairperson Copenhaver .had no .report, however, requested a meeting of the 8336 .March 1, 1988 Ordinance Committee and Utilities Committee for Tuesday, .March 8th at 4:30 p.m. to .review the .water and .sewer extension policy. MAYOR'S REPORT Mayor .Hancock .had no .report. TOWN ATTORNEY'S REPORT Mr. Terwilliger presented ordinance amending Town code provision for building permit fees. Councilman Glenn so moved that x eading of the ordinance be .waived, seconded by Councilman .Neighbors and .carried. Neblett - Aye .Mary Lou Copenhaver - Aye ORDINANCE BUILDING PERMIT AMENDING TOWN CODE PROVISIONS FEES FOR BUILDING PERMIT FEES BE IT ORDAAINED By the Town Council of the Town of Pulaski, Virginia. sitting in xegular session on .March 1, 1988, that .Section 6-18 of the Town Code be, and .hereby is, amended to x ead as follows: Sec. 6-18. Permit Eees. (a) The Town Council hereby reserves the right to adopt and publish a schedule of fees for the .services of its building official and engineering department, and to amend the same from time to time, by separate resolution. Such schedule of .fees and any amendment thereto shall be in lieu of any permit fees set forth in any uniform building code adopted by the Town. (b) No .permit as .required by the town by ordinance or regulation shall be issued unless the .fee prescribed for the service shall have been .paid, nor shall any amendment to such a permit be approved until any additional fee, if any, due to an increase in the estimated cost of the building or structure, shall also .have .been .paid. This ordinance is effective upon adoption and is adopted this lst day of .March, 1988, by .recorded vote of the Town Council. Mayor Hancock read .resolution .setting schedule of fees for building official services. Crawford - Aye Mary Lou Copenhaver - Aye BUILDING PERMIT SETTING SCHEDULE OF FEES FOR BUILDING OFFICIAL FEES SERVICES BE IT RESOLVED by the Town Council of the Town of Pulaski, Virginia, sitting in regualr session on .March 1, 1988, that until further notice, the .fees to be charged by the Town of the .services of its building officials shall be as set forth on the schedule attached hereto as Exhibit A. This Resolution is effective upon its adoption and is adopted by .recorded vote of the Town Council.: Mr. Terwilliger stated a copy of correspondence from .Carter Glass .had been distributed, petitioning writ of election and that writ of election .was entered by Judge Owens on February 29. .March 1, 1988 8337 REPORT OF TOWN MANAGER HISTORIC Mr. McKeever advised that the Town was notified on February 16, 1988, that a .large residential area of the Town had been placed on the Virginia .Landmarks Register by the Virginia Landmarks Board and .has .been endorsed to the .National Register of ~~ Historic Places. At some .date in the future, Council will be asked to consider historic zoning for this area. Presently, there are no .restrictions on construction other than the present zoning and building codes. Gibson Worsham has been hired to .develop .design guidelines for this area and efforts are underway to create a Citizen Advisory Committee to assist in the writing of the guidelines. Mr. McKeever advised that the annual County spring clean up would be held from April 18 through May 13, 1988. Mr. McKeever advised that there will be several changes in house numbers in the annexed area. The primiary reason is the installation of the E-911 system. This system .requires .each house to be identified by a house number. The postal service is currently using some of the .new numbers. Mr. McKeever also advised that we will publish a reminder that the annexed .residents are required to obtain a vehicle decal from .March to August of 1988. Mr. McKeever advised that .New River .Resource Authority .was undergoing a re- organization to include Floyd County. .Representation from .members will be as follows: NRRA City of .Radford 2, Floyd County, 2 and Pulaski County 4 with one each being nominated by the Councils of the. Towns of Dublin and Pulaski. Councilperson Copenhaver made a motion that Councilman Crawford be appointed to the New River .Resource Authority, seconded by Councilman Neblett, and .carried. Mr. McKeever distributed correspondence on bond expenditure to .date. Mr. McKeever requested an Executive Session under 2.1-344 A6) legal matter. At 4:45 p.m. Councilman Neighbors .made a motion that Council go into Executive Session on a personnel matter (A1) and a legal matter (A6) under 2.1-344, seconded by Councilman Neblett and .carried. At 5:10 p.m. Council recessed from Executive .Session to return to regular session on motion .made by Councilman Neblett, seconded by Councilman Neighbors and .carried. ~.y :.~. ~., ~~. ' ~ I_~_ ~~ PUBLIC HEARING .Mayor .Hancock .called the Public .Hearing, .held jointly with the Planning Commission, HOUSING to a.~de~.~~and roll .call of Council and Planning Commission conducted.. ELDERLY .Mayor .Hancock stated the public .hearing .was being held to .gather citizen comments regarding the proposed elderly apartment complex on .Memorial Drive. There .were no comments from the public for or against this proposal. Councilman Crawford questioned if there .was any assurance that it would be .kept an elderly house complex with Mr. Hunt stating .Farmers Home regulations requires residents to be 62 years of age or older. As .far as the 20 year factor, he believed there was a requirement that requires that it remain .rental property for that particular categor housing for the elderly, for 20 years. Mr. Hunt stated the project is planned through the E~armers Home Administration with rental assistance. He felt there would be awaiting list for occupancy of the apartments. 'Councilman Crawford further asked if there .was any question that they would not receive the federal assistance that they need. Mr. Hunt replied that they .had done all Che thing that they .needed to do in the .past few months. However, there is no assurance they will receive funding as there is a great .demand for this kind of money. Councilman Graham questioned plans for .landscaping, planting of shrubs and trees - Mr. Hunt stated this .was a requirement and they planned to do a fine .landscaping job. 8 338 PUBLIC HEARING CONTINUED March 1, 1988 Councilman Johnston asked if all questions .regarding .water, sewer and pressure, installation, etc. .been answered satisfactorily with Mr. McKeever answering that the developer is responsible for extending the .water and .sewer and a written agreement will be entered into with the developer. Councilperson Copenhaver asked if brick could be used .rather than wood. Mr. Hunt stated that the .Farmers Home Administration .had also .requested this.. Dr. Anneski, Chairman of the Planning Commission, stated they had reviewed t application thoroughly and .were impressed with the project. Mr. Smith asked when this project. would be started. Mr. Hunt stated it woul e started this year or .next year. At 5:20 p.m. The Planning Commission adjourned to another room to discussed their recommendation to Council. At 5:20 p.m. on motion .made by Councilman Neblett, seconded by Councilman .Neighbors and .carried, Council .reconvened in Executive Session. At 5:40 p.m. Council .returned to .regular .session on motion .made by Councilman PROJECT APPROVED Neblett, seconded by Councilman Neighbors and .carried. Dr. Anneski advised that motion .was .made and .carried to accept the application from Hunt Associates for proposed elderly housing project on Memorial Drive as pre- sented. Councilman Neighbors .made a motion that we accept the Planning Commission's recommendation with .developer encouraged to change site plans from wood to brick.
