There .were present: .Mayor .Gary C. Hancock, presiding Councilmembers: John. A. Johnston, Robert N. Glenn, Andrew L. Graham, .James M. Neblett, James R. .Neighbors, W. H. Schrader, Ira S. Crawford, .Mary Lou Copenhaver Town of Pulaski Planning Commission: Dr. A. W. Anneski, William T. Smith, Jr., W. H. Schrader, .David .Warburton, Joe .Weddle, Andy McCready Also Present: D. E. R. Schrader John Spiers Mr. Flinchum .Mary .Lee Duncan .Rev. Bowers .Rev. Steven Ridenhour The. invocation .was given by Councilman Johnston. Finance Committee Chairman Crawford had two correction to the minutes of the. April 5, 1988, .meeting. Minutes were then approved after corrections on motion .made Councilperson Copenhaver, seconded by Councilman Crawford and .carried. Mayo. Hancock called the public .hearing that .had been continued from the .March PUBLIC HEARINGIS, 1988, meeting to order. This .hearing was held jointly with the Town of Pulaski COND. Planning Commission. Roll .call indicated that all .members .were prey°ent with the USE APPLIC.exception of Roy D'Ardenne from the Planning Commission. Vice .Mayor .Neighbors then presiding over the public hearing. on the Conditional Use Application, F & R Market, to glace underground .gasoline .tanks and .service island at their .facility on Alum Spring Road. There .were no comments from the. public or Planning Commission on this request. The Town's Engineering .Department .has previously examined this site and their only concern .was the increase in traffic, however, they felt this road could .handle the increase. Council .had also previously .requested that a new plat be submitted showing exactly where the tanks and island would be located. Miss Burgess advised that the Engi Bering Department .had reviewed the. drawing and .felt the site plan as presented at this meeting does not impose any problems. She further stated this request .was allowed as a conditional use in our ordinance as long as they .can .meet .certain criteria At 7:02 p.m. the. Planning Commission adjourned to another room to discuss their .recommendation to Council. Rev. Ridenhour addressed Council with the .request that the sidewalk be .repaired at the Trinity Lutheran Church, 5th Street and N. .Washington Ave. The .replacement of this sidewalk on 5th Street, NW .has already .been scheduled and project will be completed prior to their centennial celebration. Trees and .large tree roots will also be .removed and the Church .has advised they will plant Dogwoods in this area. As there .were no further comments from the public, .Mayor .Hancock .called for Council Committee Reports. 8360 April 19, 1988 UTILITIES COMMITTEE Chairman Johnston advised that Dr. Wicks of VPI:had made recommendations for PEPPERS the correction of the. vibration problem and .based on his .recommendations, the Peppers FERRY .Ferry Authority has recommended to English Construction, Goulds Pumps and Olver, Inc. share in the modification of the glant and the redesign of any pump or pump shafts. An answer is expected by April 22nd. PUBLIC & PERSONNEL RELATIONS, NOMINATING COMMITTEE CEMETERY TRUST FUND Chairman Neblett made a motion that .James W. Robertson be reappointed as Trustee to .Cemetery Trust Fund for three .year .term, .seconded by Councilman .Neighbors, and .carried. PUBLIC OPERATIONS COMMITTEE Chairman .Neighbors .had no report. FINANCE COMMITTEE COMMITTEE Chairman Crawford .had no report. IN STREET PROGRAM ORDINANCE COMMITTEE Chairperson Copenhaver had no report. MAYOR'S REPORT .Mayor .Hancock extended Council's sympathy. to Frank Terwilliger, Town Attorney, on the. loss of his .Father, .George .Terwilliger. Mayor .Hancock advised that the_Main Street Program Resource Team is visiting our Town with their purpose being to .gather input and .make a report to the. public and Council on Thursday. At that time they will be making recommendations on thin that.hapefully can be accomplished during the. coming .year. TOWN MANAGER'S REPORT Mr. McKeever advised that we .had .been advised by .Carter Glass and the. U. S. (ANNEXATION Justice .Department that the 1987 and 1965 annexations .have been approved. The U. S. Justice Department is required by .law to review annexation to .determine. whether minority voting strength has-been diluted. They reviewed the 1965 annexation because it .was never submitted for review. Both annexations .have now been approved. Mr. McKeever stated that the County .has determined that alleyway .garbage collection will be continued in the town. Mr. McKeever stated that the Architectural .Review Board and the .Residential SPEAK CREEK 1 MUSEUM. Historic District Citizens Committee .had extended an invitation to Council for a presentation on Sunday, April 24th. Miss Burgess advised that the. Citizen Committee .was .made up of .people who live in the. residential district in order to get their input into the possibility of whether or not it should be zoned historically An educational program .has also .been prepared. Mr. McKeever advised that Simpson Construction .was the low bidder on the cre cleaning contracts, however, he .made an alternative proposal on one of the projec (creek relocation instead of cleaning) which .has delayed awarding the. contract. Town Attorney .has advised that because of this alternative proposal the other bidders should be afforded the .same opportunity. .Because of the Town Attorney's advice and the. other bids .cannot be considered competitive, we are rejecting all bids and will readvertise the. project. Mr. McKeever is to inform Mr. .Jake Blevins, Dora Highway, of this delay in the project. A policy governing visitation to the_Raymond F. .Ratcliffe Museum .was presented. It .was felt that a representative of the. Town should be present when visitors go to the. museum. Councilman Neblett so moved that Museum Policy be adopted, seconded by Council- man Johnston,. and .carried. 8361 WATER :] ~I ~ J _~ L April 19, 1988 Mr. McKeever distributed a copy of public notice .regarding .lead in public drinkin€ ..water. The. Environmental Protection Agency requires that we run this ad which states there is a potential of .receiving .lead in the water supply. The lead is more likely to be found in the. home than it is in the .water system. Regarding our filtration plant expansion, we are .having discussions with two different agencies .regarding withdrawal .rate from .Peak Creek. It appears that everything .has .been approved and .we should be informed formally of this shortly. It is felt that a positive .decision should be coming very shortly on the. matter of .Bainbridge Subdivision being taken into the State system. All streets .have .been approved, by State and Town Engineers. Mr. McKeever also advised that foot .patrol had been increased on .Main Street due to stores staying open until 8:00 p.m. A study of our policing needs is underway and additional .data will be collected. The Planning Commission returned to .meeting at 7:32 p.m. Mr. Rocky Schrader stated that the Planning Commission recommended approval of the F & R Market Conditional Use Application with the following conditions: 1) the .map that .was presented be approved by a certified surveyor and found to be accurate within 1 ft.; 2) the pumps .have a white elevated curb;. and 3) the .canopy to .have an approved Virginia .Department of Highways and Transportation high visibility color.Vice Mayor Neighbors again presided over the .meeting. Mr. Spiers stated his client (Mr. Flinchum) would accept conditions as they ..were reasonable conditions. Councilman Neblett moved that Council accept the. Planning Commission's report, .seconded by Councilman Graham and .carried on the following .recorded vote: John. A. Johnston - Aye .James R. Neighbors - Aye Robert N. Glenn - Aye W. H. Schrader - Aye Andrew L. Graham - Aye Ira S. Crawford - Aye .James M. Neblett - Aye .Mary Lou Copenhaver - Aye Mr. Andy McCready, speaking as a citizen, recommended that on Peak Creek channeling, that Council give consideration to putting contracts 3 and 4 together and keeping them separate from 1 due to the. difference in equipment that would be .needed. He felt this might possibly .save us some money. Mr. McKeever stated this project would be put out to bid as four distinct contracts. Contractors can bid on one contract or all four contracts. The one contract from Sproules Run to .Peak Creek does require a Corps of Engineers .permit. This .can be 60 to 90 days..There is some ambiguity as to who is responsible for obtaining the permit. It should be the property owner, although the Town .can act as an agent for the. property owner. This question is before the Town Attorney at this time.
