There were present: Vice Mayor James R. Neighbors, presiding Councilmembers: John A. Johnston, Robert N. Glenn, James M. Neblett, C. E. Boyd, Jr., Ira S. Crawford, Mary Lou Copenhaver, Glen K. Aust Also present: Frank Terwilliger, Town Attorney D. E. McKeever, Town Manager Anne Burgess, Assistant to the Town Manager Ruth A. Harrell, Clerk Visitors: Dee Lindsey, J. R. Schrader, Eric Randall of the news media Don Anderson Vicki Futrell The invocation was given by Councilperson Copenhaver. The minutes of the regular meeting of August 6, 1985, were approved as NEW RIVER VALLEY AIRPORT COMM. published. Mr. Don Anderson, Chairman of the New River Valley Airport Commission addressed Council regarding their request for funding for F/Y 1985-86. Pulaski County is currently owning approximately 29% of the airport. Originally, they owned 17%. The Commission is requesting an additional $1,755 over amount the Town budgeted. In 1984-85, the Commission requested a total of $9,589 ($5,543 operation and maintenance and $4,046 for capital outlay.) In the 1985-86 Commission budget, increase was made in operations and maintenance, making the Town of Pulaski go from $5,543 to $7,298 for a total of $11,344. Mr. Anderson requested Council fund this additional money. Council had thought the request last year was a one-time item. Mr. Anderson advised it was a one-time grant to rehabilitate the runway. Councilman Crawford stated there was some confusion as requested airport budget was not received prior to Town budget preparation. After further discussion by Council, Councilman Glenn made a motion that this matter be turned back over to the Finance Committee for final review and consideration for a prospective vote on September 3rd. Motion to include that both amounts be studied; $4,046 and the $1,755. Motion seconded by Councilman Neblett. Councilman Boyd asked if State is funding with a grant, would money requested be increased again next year. Mr. Anderson stated monies we were talking about are user generated monies. Money is 95% federal, 5% state and 5% local. Councilman Aust stated this was an investment for the Town and a big asset. If Montgomery County comes it, funding by the Town will be reduced. Motion then carried. As there were no further comments from the public, Vice Mayor Neighbors called for Council Committee reports. UTILITIES COMMITTEE Chairman Johnston advised the Utility Committee, Town Manager and Town Attorney were trying to continue negotiations with the County on the various matters of concern that we have. They are trying to open up lines of communication dealing with capacity in lineswith recent Peppers Ferry expansion. POLLUTION AND SANITATION COMMITTEE Chairman Glenn had no report. PERSONNEL, PUBLIC RELATIONS AND NOMINATING COMMITTEE Chairman Neblett had no report. LAND, BUILDINGS AND STREETS COMMITTEE August 20, 1985 ~Q ~~ Chairman Boyd had no report, however, had some concerns to bring to Council.'' He stated we continue to see a lot of letter writing back and forth from Town Manager to the County regarding voluntary annexation and Principles of Agreement. and :so moved that the Town Manager attend one of the Board of Supervisors meetings and address Board to see where we stand, seconded by Councilman Neighbors. Mr. McKeever advised that correspondence indicates we should expect decision in the meeting of August 22. He further advised the legal matter scheduled for executive session is a legal matter and eligible under the Act. Councilman Boyd withdrew his motion and Councilman Neighbors withdrew his second. Mr. Terwilliger advised he believed this was covered as a legal matter, 2.1-344 (A6), however, he pointed out that if any vote is taken or give any direction in reference, take any action in executive session, action will have to be taken in open session before it is effective. RECREATION AND PARKS COMMITTEE Chairman Neighbors had no report. FINANCE COMMITTEE Chairman Crawford advised the Finance Committee had received the Director of Finance annual report on delinquent taxes, improper and erroneous assessments for the year 1984, 1983, 1982 and 1981, and there are several resolutions we must consider and take action on. Aust - Aye BE IT RESOLVED that the above set out Town Treasurer's report for delinquent taxes for the year 19$4, as certified to the Council accepted: that the Treasurer be certified with the amount shown to be delinquent and that said list of delinquent real estate tax be filed with the Clerk of the Circuit Court of Pulaski County, Virginia, to be recorded and indexed by him; that a list containing all unpaid real estate taxes as of June 30, 1985, to be published in a local newspaper on Tuesday, August 29, 1985, that a list of unpaid personal property and any and all other taxes be prepared; that such lists be posted at the Courthouse and other public places all said proceedings to be in accordance with the provisions of the Code of Virginia., 1950 Edition, Title 58, Chapter 20, Article 7, and Chapter 21, Article 7, and all applicable amendments to the said code. Councilman Crawford advised that committee had discussed financing of Peppers Ferry commitment of the future, and the Town was to seek out best rate of interest and line of credit for one-half million dollars. The lowest quote received, with an interest rate of 62~ of prime or fixed rate of 6-3/4~ was received from Sovran Bank. Chairman Crawford made a motion that we go ahead and authorize our Town Manager and Treasurer to establish line of credit for one-half million dollar s with Sovran Bank, to be drawn .down as needed to meet our commitments on Peppers Ferry, seconded by Councilman Boyd, and carried on the following recorded vote: John A. Aust - Aye Encroachment AN ORDINANCE PERMITTING AN EXISTING ENCROACHMENT Ordinance UPON TOWN PROPERTY BY A WALL AND BUILDING OWNED BY MARK BOWER ON A SOUTHERN PORTION OF LOTS NOS. 1, 3 and 5, BLOCK 28 OF THE TOWN OF PULASKI, VIRGINIA BE IT ORDAINED by the Town Council of .the Town of Pulaski, Virginia, sitting in regular session on the 20th day of August, 1985, that: WHEREAS, the wall of a certain building already existing on the Southern Portion of Lot 5, in Block 28, which building is now owned by Mark Bower, has been found to encroach on a certain 12' public alley on the eastern side of said building; and, WHEREAS, a wall already existing on the southern portion of Lots 1, 3, and 5 of Block 28, now owned by Mark Bower, has been found to encroach on a certain 20' public alley on the southern side of said lots; and WHEREAS, the encroachment of said building has been found to be 2.3 feet at .the northernmost corner of said building, narrowing to 0 feet at the southest corner of .said building; and,. the encroachment of said rock wall has been found to be 4'; both of which. encroachments are shown on a plat entitled "Physical Survey for Richard D, and Pamela A. Jones of a S. Part of Lots No. 1, 3 and 5, Block 28 as shown on the Official Map of the Town of Pulaski, Pulaski County, Virginia" prepared by Neal H. Wirt, Registered Surveyor, dated July 17, 1985, a copy of which is attached hereto, and made a part hereof; and, WHEREAS, the encroachment has existed for a substantial number of years and there is no reason to know that the encroachment has interfered with or obstructed the use of either of said public alleys; and, WHEREAS, the present owner is desirous of clarifying his rights, duties, and obligations for himself and his successors and assigns. NOW, THEREFORE, BE IT ORDAINED, pursuant to Section 15.1-377 of the 1950 Code of Virginia, as amended, that Mark Bower, the present owner, and his successors and assigns, be and hereby, is authorized to maintain said encroachments as they currently exist as shown on the afore- said plat of July 17, 1985, until such time as the building or wall is destroyed or removed. BE IT FURTHER ORDAINED that when and if any portion of said building be removed or destroyed, or if any portion of said wall be removed or destroyed, then this authorization shall at once cease as to the encroach- ment along such portion of the building or wall destroyed or removed, and, further, this authorization is subject to the proviso that nothing herein contained shall be construed to impose upon this municipality any obligation whatsoever for the existence of said encroachment or to impose upon this municipality any liability to any person whomsoever by reason of this authorization, and that nothing herein contained shall be construed to relieve said owner, its successors or assigns, of any liability for negligence on their part or otherwise on account of such encroachment. This Ordinance shall be in full force and effect upon its adoption. Mr. Terwilliger requested an executive session on a legal matter under 2.1-344 (A6), Code of Virginia. REPORT OF TOWN MANAGER Mr. McKeever advised that correspondence had been distributed to Council, ARMORY from the Department of Military Affairs with proposed amendment No. 1 to the Pulaski Armory Resolution dated April 1, 1958. The amendment provides a more equitable sharing of the costs between the Town and the Department of Military Affairs. Mr. McKeever requested that Council authorize the Town Manager to sign the amendment and return to the Department of Military Affairs. Councilman Boyd so moved to authorize Town Manager to sign resolution seconded by Councilman Crawford and carried. ~~ 1 lJ August 20, 1985 ry8~ AMENDMENT N0. 1 TO ARMORY RESOLUTION This Resolution entered into this 10th day of August, 1985, by and between the Town of Pulaski, Virginia, Party of the first part, referred to as Town, and the COMMON- WEALTH OF VIRGINIA, .DEPARTMENT OF MILITARY AFFAIRS, Party of the second part, here- inafter referred to as DMA, will amend the Armory Resolution dated April 1, 1958 1. The Town agrees to: A. Reaffirm its commitment to provide the operational cost as outlined in the original Resolution dated April 1, 1985 (ie. Lawn care, heating fuel, janitorial, etc.) B. Reaffirm it's commitment to continue the routine maintenance and repair cost as outlined in the original Resolution (ie. light bulb replacement, lubrication of motors, air filter changes, etc.) 2. The DMA agrees to: A. Reimburse the Town the approved costs of major repairs (ie. boiler replacement, roof replacement, etc.) of the armory. B. Reimburse the Town for up to 25~ of their routine maintenance and operational-costs, upon approval of proof of payment from the Town. C. Allow the Town to retain .any rental receipts collected, up to actual expenses incurred for routine maintenance and operation. Reservation will be made for one room for Council's use. Registration forms should also be turned in as soon as possible. Mr. McKeever stated the Town had received a $25,000 Community Development GRANTS Block Planning Grant in order to plan the housing grant that has been discussed. Mr. McKeever advised there is a public hearing on proposed water policy legis- PROPOSED lation in Abingdon on August 29 at 7:30 p.m. There is also a public hearing by the WATER LEGISLA. Planning District Commission on August 22 at 8:00 p.m. This legislation may become the most important consideration of the 1986 General Assembly as this act would govern the location of water sources and perhaps redirect water to locations where a source of supply is limited. Mr. McKeever urged the Utility Committee members to attend these public hearings. Mr. McKeever advised the Town offices would be closed Monday, September 2, 1985, in observance of Labor Day. Mr. McKeever also requested an executive session under 2.1-344 (Al) Personnel Matter, (A2) Real Estate Matter and (A6) Legal Matter.
