Minutes of the Special Council Meeting of the Pulaski Town Council held
December 30, 1985, at 4:00 p.m. in the Council Chambers in the Municipal Building.
There were present: Mayor Gary C. Hancock, presiding
Councilmembers: James M. Neblett, C. E. Boyd, Jr., James R. Neighbors,
Ira. S. Crawford, Glen K. Aust
Also present: Frank Terwilliger, Town Attorney
D. E. McKeever, Town Manager
Anne Burgess, Assistant to the Town Manager
Ruth A. Harrell, Clerk
Visitors: Pierre Thomas of the news media.
Gary Cutlip, Town Treasurer
The invocation was given by Councilman Neighbors.

WAIVER OF NOTICE OF SPECIAL MEETING i
We, the undersigned, duly elected members of the Council of the
Town of Pulaski, Virginia, hereby waive notice of a Special Meeting
of said Council at 4:00 p.m., on the 30th da of December, 1985, for
the purpose of changing the regular meet
in January, 1986, and any other business

The purpose of the special meeting was to change the regular meeting date of
the first meeting in January, 1986.
The public hearing to be scheduled on the proposed changes in the Town Charter
was discussed.

Councilman Neblett so moved that the January 7, 1986, and January 21, 1986,
Council Meetings be changed to January 14, 1986, at 4:00 p.m. and public hearing
on proposed changes to Town Charter be held on this date, seconded by Councilman ---
Neighbors.
Mr. Terwilliger requested vote be postponed until after an Executive Session
concerning legal interpretation under 2.1-344 (A6).
Councilman Crawford made a motion that Council go into Executive Session,
seconded by Councilman Boyd and carried.
At 4:12 p.m. Council went into Executive Session.
At 4:41 p.m. Council returned to Special .Session on motion of Councilman
Neblett, seconded by Councilman Boyd and carried.

Councilman Neblett amended motion to include that a special meeting also be
scheduled for Friday, January 3, 1986, at 12:00 noon to approve a draft of the
Charter to send to Legislature. Councilman Neighbors seconded amendment and motion
carried.
Mr. McKeever requested Council to consider another item concerning our property
liability and auto insurance.
Councilman Aust so moved that Council consider this item, seconded by Councilman
Neighbors and carried.
Mr. McKeever advised that they had been working to obtain a consultant to review
our insurance coverage. Council has authorized that we obtain extension on our
coverages until Jute 30th and these have been granted. Difficulty has been experienced
in finding a consultant as no bids were received in answer to our advertisement. We
have!now been in touch with a municipal consultant and an appointment is scheduled
for January 9th. He will look at our present coverages and claims before he wild give
us a cost for him to consult for the Town.
Presently, our property, general liability and auto insurance is with various
companies through Old Dominion Insurance. Last year we were quoted these coverages
would be for three years and premium would increase over a three year period. Last
year,. for this coverage we paid $71,559 and this year the premium as proposed is'
$78,211. The six month extension would cost us $39,106. The underwriter has informed
Old Dominion of these costs, and we received on December 27th. They have stated ,if we
were to only extend it to June 30th, not extend it any further, and not go out to bid
on all coverages, Continental (who has our general liability), will not bid on
Pollution Liability Insurance. If we go ahead and approve this $6,000 increase, ~we
would have the pollution liability insurance for the next two years because it wras
in the original three year proposal.
If we were to accept the full bid, the only way we could do it is to declare an
emergency purchase based on the fact that we would lose coverage for pollution
liability for the next two years.
Mr. Terwilliger advised that under code, 11.41E, that basically it states if' we
declare an emergency exists, then we are excused from competitive procedurement section
of the code. He gave the requirements we must meet if an emergency procedure is
necessary.
The Pollution Liability insurance is an important coverage, especially since. we
will be going on Peppers Ferry in the near future<and we are one of the owners of
Peppers Ferry.
As decision did not have to be made at this meeting, Council will await findings
of insurance consultant's review and his recommendations. Without charge, he will
look at our present coverages and our claims to make a recommendation as to what it
would cost us for him to do an in-depth study to make recommendations to us.
At 5:01 p.m. on motion made by Councilman Neblett, seconded by Councilman Boyd,
and carried, Council adjourned.
