FOR REPORT TO COUNCIL PUBLIC HEARING RE: VETERANS HILL GRANT Minutes of the regular meeting of the Pulaski Town Council held May 5, 1981 at 4:00 P. M. in the Council Chambers in the Municipal Building. There were present: Mayor Raymond F. Ratcliff, presiding. Councilmembers: Robert M. Wallace, John A. Johnston, C. E. Boyd, Jr., Andrew L. Graham, Jr ., Alma H. Holston, James M. Neblett, Jr., Pauline G. Mitchell, Glen K. Aust Also present: H. R. Coake, Town Manager Gladys R. Dalton, Clerk John J. Hawley, Town Engineer Garnett S. Moore, Town Attorney Roger A. Williams, Treasurer Visitors: Jane Graham and Doug Waters of the Southwest Times and Roanoke Times, respectively, Tom McCarthy, Atty. for Hercules, Inc. Teresa Underwood, Senior Center Director Bill Hall, Fire Chief Approximately 10 citizens interested in amendment to CBD Grant ~~B-79-DN-51-0122 The invocation was given by Councilman Bold. The minutes bf the regular meeting of April 21, 1981 were approved as recorded. Tom McCarthy, attorney for Hercules, Inc., appeared before Council and requested, on behalf of his client, that lands near the Hercules plant in Pulaski which had been acquired by Hercules, be rezoned from R-2 to M-1 classification. (The area to be rezoned was outlined on a map prepared by the Town's Engineering Department ). Mr. McCarthy asked that Council refer this request to the Town Planning Commission for a public hearing and report to Council. The formal request was received and filed. Councilman Neblett moved that by proper transmittal latter, the petition of Hercules, Inc., be ref erred to the Planning Commission. Motion was seconded by Councilman Graham, and carried on the following vote: John A. Johnston - Aye Andrew L. Graham, Jr. - Aye Pauline G. Mitchell - Aye Glen K, Aust - Aye Robert M. Boyd, Jr. - Aye James M, Neblett, Jr. -Aye Town Council held a public hearing to provide citizens an opportunity to participate in the preparation of the Program Amendment n I J 6874 May 5, 1981 to the Community Development Block Grant Number B-79-DN-51;0122, which grant was awarded to the Town for the installation of a water distribu- tion system for the Veteran's Hill area that lies adjacent to the north- ern corporate limits of the Town of PUlasd . Town Engineer John Hawley gave a narrative of the program amendments, in which it was indicated bids that were received on the PUBLIC project were below engineering estimates; theref ore, there are excess HEARING funds available in the grant for additional construction projects. The VETERANS Town is requesting the following amendments be made to B-79-DN-51-0122 Grant to be constructed with the excess funds: HILL GRANT (1) Reprogram funds to pay individual connection fees for residents of the area in Veteran's Hill served by the extension of the water system. TO INSTALL (2) Reprogram funds to pay individual connection fees for residents of areas served by the B-76-DN-51-0122 Sewer WATER LINES Extension Grant which was for Case Knif e, Crestline Drive and Russell Birch-5th Street Southeast areas; the B-77-DN-S1-0122 Water Extension Grant for Thaxton ADJACENT TO Road and Thaxton Street; and the B-78-DN-51-0122 Sewer Extension Grant for Garner Avenue, Stuart Avenue, AREA and Crestline Drive. Reimbursements will also be made to individuals who have previously paid for the connection fees and are eligible to receive this benefit. (3) Reprogram funds for the extension of a 6" water line and the placement of afire hydrant on Smith Lane to improve fire protection. (4) Reprogram funds to construct a water line and appurte- nances along Brookmont Road for approximately 6,000 feet from the intersection of Brookmont Road and Thaxton Road. Mr. James White and Mrs. Clarence Burton spoke concerning the reprogramming of funds to construct a water line and appurtenances along Brookmont Road for approximately 6000 feet from the intersection of Brookmont Road and Thaxton Road. Mayor Ratcliff called for Committee reports. UTILITIES COMMITTEE: The Utilities Committee met with representatives from the County COMM. MET and had preliminary discussions about the Mount Olivet Water System, and WITH COUNTY RE: Mt.OLIVET also rates for sale of water and treatment of sewage, and it was hoped WATER SYSTEM to have a report later for Council, advised Councilman Johnston. Councilman Johnston reported the Pepper's Ferry Regional Waste- water Treatment Authority seems to be off the ground and running - they s$~z~ May S, 1981 have some money for operation. He stated the Authority selected BANK OF the First National Bank of Christiansburg to serve them - this Bank CHRISTIANSBURG TO SERVE submitted the most generous offer of buying bonds. Bills are being PEPPERS FRY. WW TREAMTNET received for Engineering, Legal Fees and Audits. DUTY. RECREATION COMMITTEE: Councilmember Mitchell advised that members of the Council had received a copy of Town Manager Coake's letter dated May 1, 1981 relative to Loving Field Softball Tournaments, and called on Mr. Coake to briefly state again the recommendation regarding the REPORT OF the handling of softball tournaments at Loving Field. TOWN MGR. Mr. Coake stated that in order to receive the revenue COAKE REL. from softball tournaments, it is suggested that all softball tourna- TO LOVING FIELD ments scheduled for Loving Field be sponsored by the Town of Pulaski SOFTBALL Department of Parks and Recreation, and that other organizations TOURNAMENTS would not be permitted to schedule softball tournaments at Loving Field. Further, that the Recreation Director would be responsible AND for the tournaments and may request assistance from volunteers to APPROVED BY assist in the tournament activities; all entry fees would be collected by the Treasurer of the Town and accounted for under a newly created COUNCIL line item in General Fund Capital outlay account. Councilmember Mitchell moved that the Letter dated May 1, 1981 from Town Manager Coake regarding softball tournaments at Loving Field, be received and filed, with the approval of the Council for said proposals. COAKE a report on inquiry relative to cutting trees on the shore line o f ~ REPOR'1S ON CUTTING Gatewood Reservoir to create a better fish habitat.. Town Manager TREES AT GATEWOOD LAKE Coake advised that he had received no objection on this proposal from the State; Commission on Game and Inland Fisheries and State Water AND Control Board. Gouncilmember MitcYe 11 moved that the Town Manager proceed APPROVED BY to mark and cnt certain trees around the Gatewood impoundment in order COUNCIL to enhance the fish habitat, and that the cutting of trees be u [1 reviewed from time to time upon Council's motion. Motion was ss~ s May 5, 1981 seconded by Councilman Wallace. There was much discussion relative to the fact that Gatewood OPPOSITION TO CUTTING .\ TREES AT GATEWOOD RESERVOIR Reservoir is a source of water for the Town of Pulaski people, and for this reason Councilmember Graham and Holston said they would have to vote against the proposal. It was also brought out that by the Town cutting the trees and anchoring them to the bank or shore, would be a much better procedure than allowing trees to fall in the reservoir and become floating debris. ON GAZEBO FOR JACKSON PARK, & SENIOR CITIZEN ADVISING THEY WILL BE RESPONSI- BLE FOR FINANCING, ETC. report at this time. LAND AND BUILDING COMMITTEE: Chairman Boyd advised that he had to be out of Town when the Committee met with the Senior Center Advisory Council relative to the Gazebo, and had asked Councilman Graham to report on the Committee meeting. Councilman Graham advised that at the last Council meeting construction of the Gazebo had been referred to the Land and Building Committee, to meet with the Senior Center Advisory Council. Mr. Graham advised a letter from the Senior Center Advisory Council addressed to the Pulaski Town Council and to the Attention of Mr. Boyd, Chairman of the Building and Land Committee, was received, as follows: "We, the undersigned members of the Pulaski Senior Citizen Center Advisory Council pledge to accept the challenge of soliciting funds and construction materials for the proposed Gazebo to be erected in Jackson Park, down- town Pulaski. We, in turn pledge to see the Gazebo project through to it's completion, to the best o~ our ability". Mr. Graham reported the Senior Advisory Council requested that Town Council not require collection of funds in the amount necessary to purchase all materials before a building permit is issued, because the Advisory Council was of 6 8 ; "; May 5, 1981 the opinion that supporters of the Gazebo would more readily make contributions to the project if construction had started. Mr. Graham stated it was also noted that the assistance of the Treasurer/Finance Director would be offered to accept and record contributions for the project, and that limited supervisory assistance of the Town staff in design and construction of the Gazebo would be available. Also discussed at the meeting that the Town would reserve the right to give final approval to the project and to approve plans for the Gazebo as well as any revisions. Upon the issuance of a building permit, the Town Building Inspector will inspect the structure during construction and the person in charge of construction will be responsible for notifying the Building Inspector when inspections are necessary. It was brought out that $1,000.00 has ~aeen received at this time for the construction of the Gazebo, and the Senior Advisory Council asked that the Town delete their stipulation that no building permit be issued until sufficient funds are received for the construction of the Gazebo. Councilman Graham moved that Council accept the letter of the Senior Center Advisory Council in good faith that the Gazebo will DELETE TOWN be built, and the requirement of the Town that they collect sufficient TO COLLECT MONEY TO PAY funds for the balance of the materials for the construction of the FOR MATERIALS FOR CONSTR. Neblett, Jr. - Aye Mr. Boyd stated there was concern relative to the recent news report which stated that Hogans and Gatewood Dams were anong those TOWN MGR. COAKE REPORTS ON in Virginia that were unsafe, and that Mr. Coake will have a report SAFETY OF HOGAN & GATEWOOD DAMS on this for Council later on. Mr. Coake advised that he did not feel there was any structural defects; however, he would be making a report at the next meeting. Councilman Boyd moved that the mater of the closing of the office of the Virginia Employment Commission in Pulaski be placed on MOVING OF VEC the agenda for immediate discussion. Motion was seconded by Councilman PLACED ON AGENDA FOR DISCUSSION Johnston, and card ed. X878 May 5, 1981 Councilman Boyd opposed the closing of the local Virginia Employment Commission office and making the Wytheville office, which has only been a satellite office, the main office of VEC. Mr. Boyd stated this would be an inconvenience to the citizens of Pulaski County to have to drive to Wytheville for service; that Pulaski is the most industrial area between Roanoke and Bristol and this would also work a hardship on industry. Mr. Boyd further stated that Pulaski lost the C. & P. Telephone office to Blacksburg, and now the VEC office to Wytheville, and he thought it was OPPOSE time to speak up and oppose.-.this move. Council was in agreement. MOVING OF VEC OFFICE Councilman Boyd moved that Town Attorney Moore prepare a TO WYTHEVILLE document, addressed to the proper authorities, showing that Council opposed the closing of the VEC office in Pulaski. Boyd, Jr. - Aye FINANCE COMMITTEE: Andrew L. Graham, Jr. _ Aye Glen K. Aust - Aye Alma H. Holston - Aye James M. Neblett, Jr. - Aye Councilman Graham advised that the Finance Committee met and discussed the purchase of a pumper truck for the Fire Department. He stated the one in use now is twenty-five years old and repairs for APPROVE PURCHASE OF it are hard to get. He advised there was $50,000 in Revenue Sharing FIRE PUMPER TRUCK - $80,000budget; that bids were received from two firms, and the low bid was COMPLETE for $80,000 complete. Councilman Graham moved that the Town Manager issue a purchase order for the Fire Department Pumper Truck not to exceed $80,000. Councilman Aust moved that the Fire Lana ordinance be adopted to become effective July 15, 1981. Motion was seconded by Councilman Neblett, and carried on the following vote: ADOPTION OF John A. Neblett, Jr. - Aye ORDINANCE AN ORDINANCE TO AUTHORIZE THE ESTABLISHMENT OF FIRE LANES AND ADJACENT TRAFFIC LANES S1~I CERTAIN LOCATIONS ON PUBLIC AND PRIVATE RIGHT OF WAYS AND ON PRIVATELY OWNED PROPERTY USED FOR COMMERCIAL OR PUBLIC PURPOSES AND THE REGULATION THEREOF: TO PROVIDE INGRESS AND EGRESS THERETO: AND PENALTY FOR VIOLATION OF THIS ORDINANCE. BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, meeting in Regular Session on this 5th day of May, 1981, that: The Council finds that in order to protect the citizens and their property and to provide for the health, saf ety and general welfare of persons and property within the Town that it is necessary to establish, both on public and private property, fire lanes, rules and regulations governing their regular use and the use of certain areas adjacent thereto, to provide free access to buildings for fire fighting and other emergency vehicles in case of fire or other emergencies. Sec. I - Definitions 1 1. Fire Lanes; Area reserved and marked and with s$$a play S, 1981 FIRE LANE ORDINANCE [] appropriate signs for use by fire and other emergency vehicles and apparatus in which parking and other obstructions will be prohibited. 2. Parking: Leaving a vehicle - stopped and unattended. 3. Agent: Fire Chief or his designated assistant. 4. Town Manager: Town Manager or Assistant Town Manager of the Town of Pulaski, Virginia. 5. Town: The Town of Pulaski, Virginia. 6. Police Officer: Any law enforcement officer authorized to make an arrest or preserve the peace. 7. Lanes adiacent to Fire Lanes: Any public or private roadway upon which traffic moves either as thru-traffic or traffic within the bounds of the subject property. 8. Emergency Vehicle s_: Fire Department„ Life Saving and Rescue vehicles, equipment and apparatus. Sec. II - Fire Lanes 1. The Town Manager or his agent is hereby authorized to establish and designate, on public or private property used for commercial or public purposes, fire lanes within the Town where in his judgment and opinion fire lanes are deemed necessary in order to allow fast and unimpeded access to buildings, their access and egress facilities, for emergency vehicles and their personnel, to provide efficient and effective fire protection and emergency services. 2. All fire Lanes shall be plainly marked with signs and street markings; the width of the lanes shall be not less than eight (8) feet measured from existing curbs or from the edge of the pavement where no curbs exist, unless the topography of the street, architectural design of the buildings, entrances for ingress or egress, or other factors are such as would, in the exercise of good judgement dictate a lesser width. Lanes shall not be of a greater width than twelve (12) feet unless the same factors stated above for marking a lane less than eight (8) feet are used. 3. Marking and approved signs to designate fire lanes shall be either provided by or if provided by the Town at the Town's sole determination, shall be paid for by the owner or agenst of the property involved, under guide- lines established by this ordinance or by the Town Manager or through his agent. 4. The curb or pavement edge of all fire lanes shall be painted yellow. Any existing marking in the area designated a fire lane or other markings shall be obliterated or painted over in a manner approved by the Town Manager. or his agent. 5. The design of signs shall be such as approved in the Virginia Manual on Unif orm Traffic Control Devices and shall be marked "No Parking - Fire Lane". The signs shall be located every 100 feet or, if the Town Manager or agent determined it is necessary to install additional signs, the owner or agent shall install and locate such signs in a proper position and sufficiently legible to be seen by the ordinarily observant person. The signs shall be placed as follows or as directed by the Town Manager or agent. 6881 May 5, 1981 Sec. III - Traffic Lanes FIRE LANE Parking or obstructing traffic lanes adjacent to ORDINANCE established Fire Lanes is hereby prohibited. Property owners or their agents shall mark all such pavement or traffic ways with No Parking signs and where deemed necessary, by the Town Manager with appropriate up-right signs. Sec. IV - Violations and Penalty POLLUTION AND SANITATION COMMITTEE: NO REPORT ON TAXICABS time on the Taxicab matter, and the matter of houses being built on streets which have not been taken into the Town's street system. PUBLIC & PERSONNEL RELATIONS AND NOMINATING COMMITTEE: Councilman Neblett advised that he had no report from his Committee at this tiiae. Mr. Neblett asked Town Attorney Moore to present the Resolution NO FURTHER time. However, inquiry was made as to the status of the Ward Lane closing, REPORT ON WARD LANE CLOSING _ and was advised that nothing further had been heard from the School Board. It shall be unlawful for any person to park or obstruct a Fire Lane or Traffic Lane in any manner. Any violation of this ordinance is hereby deemed to be a misdemeanor and upon conviction thereof shall be punishable by a fine of Five Dollars ($5.00) for each separate violation. 2. Police officers of the Town of~ Pulaski, upon observing a violation of this ordinance, shall issue a traffic ticket for the violation in the same manner and procedure as provided for the issuance of traffic tickets under the Pulaski Town Code. This ordinance shall become effective July 15, 1981. Councilman Aust advised his Committee had no report at this Chairman Holston advised she had no Committee report at this 1984. TOWN ATTORNEY: As had been directed by the Council at its meeting on April 21, 1981, Town Attorney Moore presented a letter to the Members of the Pulaski County Board of Supervisors and Mr. Sidney A. Clower, County Administrator, dealing with the plan for expansion of the corporate limits without the necessity of an annexation proceeding which was MAYOR, TOWN MGR.
