There were present: Mayor Raymond F. Ratcliff, presiding. Council members: Andrew L. Graham, Jr., Robert M. Wallace, Alma H, Holston, James M. Neblett, Jr ., Glen K. Aust, C. E. Boyd, Jr., John A. Johnston, Pauline G. Mitchell Also present: H. R. Coake, Town Manager Gladys R. Dalton, Clerk Garnett S. Moore, Town Attorney Roger A. Williams, Treasurer Visitors: Dee Lindsey, Vicki Futrell, Bob,Alley, Dora Highway (Cool Spging) Delegation, Mrs H. Porterfield The invocation was given by Councilman Neblett. The minutes of the Regular meeting of August 18, 1981 were approved as recorded. Mayor Ratcliff advised that as had been advertised in the local newspaper, Council would hold a public hearing, as required, in the Town's application to U. S. Department of Housing and Urban Development for Community Development Block Grant funds for constructing the Cool Spring Water Distribution and Sewage Collection System._ Mayor Ratcliff advised Council would be glad to hear any one who wished to speak on this subject. Raymond Stout, a resident of the Cool Spring area, advised Council of the critical need of water in that area. PUBLIC HEARING HUD COOL SPGS. Ms. Ruth Dalton, another resident of the Cool Spring area, advised GRANT she had been without water for several days and had to resort to having water hauled; stating that "we need water badly". Town Manager Coake advised the Town filed a preapplication in the APPLICATION late winter or early spring for a Community Development Block Grant to TO BE FILED construct a water distribution system for Cool Springs, and were advised that our preapplication for this project did not rate in the highest priority to insure funding; however, we were invited to submit a full application in the event that not all funds would be allocated during the processing of full applications to those communities in the highest priority category. There is no assurance that we will receive these funds; however, we are submitting our application in the hope that if the funds become avail- able, the Town's application will be appra~ed. fi981 September 1, 1981 Mr. Coake advised that the main purpose of this public hearing is to obtain the views of the citizens on Community Development and Housing needs and provide citizens an adequate opportunity to participate in the development of any revisions, changes, or amendments to the application. As had been advertised in the local newspaper, Council held a public hearing on the application of Harrison T. Porterfield for permission to place a mobile home on lot located at 109 Pine Street,S.E. No one spoke regarding this application, and Mayor Ratcliff called for the Town Manager's report. PUBLIC HEARING Mr. Coake advised the proposed location is on lots which contain HARRIS~N T. PORTERFIELD 7,500 square feet which does not meet minimum lot size requirements as TRAILERAPPLICA. specified in the Zoning Ordinance; however, the lots were subdivided prior to the Zoning Ordinance, and under the "grandfather clause" can APPROVED BY COUNCIL be so used provided setback requirements are met. Town Manager Coake advised the Lot is owned by Mr. Porterfield's father, is alocated in an R-2 Residential area, and there have been no objection from adjacent property owners. It was recommended that the application be approved. Councilman Aust moved that the application of Harrison T. Porterfield to place a mobile home at 109 Pine Street, S. E. be approved. Vicki Futrell, Executive Director of the Pulaski County Chamber CHAMBER OF COMM. REPORT of Commerce, gave Council a brief report of the varioy[s activities of the Chamber, as well as a report on area developments. Mayor Ratcliff called for Committee reports. UTILITIES COMMITTEE NO REPORT Chairman Johnston had no report. RECREATION COMMITTEE NO REPORT Mrs. Mitchell advised that the Recreation Committee had met recently, but there was no report at this time. September 1, 1981 STREET COMMITTEE 6982 Mr. Wallace advised that Mr. Alley was present regarding their request to the Town for a cul-de-sac for Overton Drive, and the Street Committee met and considered this and we asked that the Town Manager contact them. Mr. Coake advised that it was the recommendation of the Street Committee that the Alleys be contacted to see if they would pay one-half and the town one-half of the estimated cost of installing the cul-de-sac. Mr. Bob Alley advised that Overton Drive was approved by the Planning Commission in 1965, and no provision was made for turning on Overton Drive, CUL-DE-SAC COMPLAINT: the residents have been providing this. Mr. Alley advised that culverts REF . TO ST. COMM. were installed according to Town specifications, and now water is the main & TOWN MGR. TO MEET problem. Mr. Alley stated they would like to request the Town to install a cul-de-sac on Overton Drive at the Town's expense, that will do away with the water problem. Much discussion was had, and Couneilmember Holston moved that it be ref erred back to the Street Committee and Town Manager; that they meet with Mr. Alley and obtain his suggestions. Motion was seconded by Councilman Boyd, and carried. Councilman Wallace asked that the sidewalk on the north side of 10TH ST. Tenth Street, between Prospect Avenue and Randolph Avenue be replaced. SIDEWALK TO BE INSTALLED Mr. Wallace also asked that a sidewalk be installed on the north side of First Street from the Municipal Building to Jeff erson Avenue. LAND AND BUILDING COMMITTEE On behalf of the Land and Building Committee and Cemetery Committee Attorney Garnett S,. Moore presented to Council a Certificate of Subdivision CEMETERY CERTIFICATE of Oakwood, Oakwood East, Pinehurst and Pinehurst Addition Cemeteries, OF SUBDIVISION & MAPS together with maps of said Cemeteries, to be used in future sales of grave APPROVED spaces. MAYOR TO SIGN Also presented by Mr. Moore was a Resolution accepting the Certificate SUBDIVISION CERTIFICATE of Subdivision and directing the Mayor to Execute the Certificate of BY RESOLUTION AS FOLLOWS Subdivision on the part of the Town. Councilman Boyd reported that the Consulting Firm of Municipal Advisors of Virginia Beach, would be visiting with the Committee on Consolidation on Thursday of this week. Town Attorney Moore presented an Easement Agreement between the Town of Pulaski and Linda Aust Johnson and James K. Johnson, her husband, and Flora P. Aust, widow, conveying to the Town an easement for a water COUNCIL ADOPTS RESOLUTION line over and across their property on Alum Spring Road in Pulaski RE: EASEMENT AGREEMENT FOR County. WATER LINE ON ALUM SPG.RD. Also presented by the Town Attorney was a Resolution directing JOHNSON & AUST PROPERTY the Mayor to execute-:said Easement Agreement on the part of the Town. FINANCE COMMITTEE Councilman Graham reported the Finance Committee met and con- J sidered certain financial matters. Mr. Graham moved that expenditures be 6984 approved for the following from previously budgeted Revenue Sharing Funds: COUNCIL Acct. ~~404.5 Fire Dept.-Radio Equip. $ 600.00 APPROVES Acct. ~~409.0 Radio Equip. TAXES °f delinquent taxes, and it was hoped some plan can be worked out whereby DISCUSSED the Treasurer will be able to follow up on these taxes. Councilman Graham advised the Committee recommended the approval I ~I i APPROVES of $5,000.00 from Refuse Disposal Account No. 091-300.6 for the purchase PURCHASE OF 6 DUMPSo~Rsix dumpsters, and so moved. Neblett, Jr. - Aye Chairman Graham advised the Finance Committee considered the re- COUNCIL quest of the Count Pulaski Celebration Committee for a contribution of TO CONTRIBUT $175.00 FOR 150 - $200, to help fund the Count Pulaski Celebration activities COUNT PULASKscheduled for October 11-17, 1981:, and the Committee recommends that DAY s~s5 September 1, 1981 the.Town make a contribution of $175.00 to the Count Pulaski Celebration Committee, to be charged to Account 011-201.2, Mr. Graham so moved, and the motion was seconded by Councilman Boyd. Councilmember Mitchell made a substitute motion that the Town MOTION FAILED FOR LACK OF contribute the amount of $200.00 which was requested. Neblett, Jr. - Aye ORDINANCE COMMITTEE Chairman Aust reported the Ordinance Committee met and discussed three subjects: Parking Fines, Taxicab Rates, and Town Tags. Councilman Aust advised that it was the recommendation of the Committee that the amount of the fine for over-time parking on parking meters be increased from 25C to 50C instead of an increase COUNCIL ADOPTS of $1.00 which had been suggested by Councilman Wallace. ORDINANCE INCREASING Town Attorney Moore presented an Ordinance to Amend Section OVERTIME PARKING FINE FROM 25fi 16-77 of Article VII Traffic Violation Notices, and ro re-enact TO 50~ Section 16-77 as 16.77.1 as amended, establishing the Fifty Cent fine for each violation notice. Councilman Aust moved the adoption of the Ordinance as presented and read by Town Attorney Moore. Motion was seconded by Councilmember Mitchell, and Councilman Johnston suggested that the. parking meters should be checked for repairs before this ordinance becomes effective, Motion carried on the following vote: John A. Neblett,"'Jr. - Aye AN ORDINANCE TO AMEND SECTION 16-77,OF ARTICLE VII TRAFFIC VIOLATION NOTICES AND TO RE-ENACT. SECTION PARKING FINE 16-77 AS 16-77.1 AS AMENDED ORDINANCE Y BE IR ORDAINED by the Council of the Town of Pulaski, Virginia, meeting in Regular Session on this 1st day of September, 1981, that: ARTICLE VII - Traffic Violation Notices Sec. 16-77.1 - Generally. Traffic violation notices shall be issued to vialators of parking regulations and all nonmoving regulations with the exception of persons charged with specific violations under circumstances September 1, 1981 which. warrant action other than traffic notices, in which event the usual procedure of summons or arrests shall apply. Nonmoving violations included in the of oresaid shall be overtime parking at meters,,overtime parking in limited-areas, parking in prohibited areas, parking on siidewalk, parking overtime it] 14ading :z~r~es, blocking driveways. improper parking and parking more than eighteen inches from curb or parking within fifteen feet of fire hydrant . ~i ~.J I I J Traffic violation notices given for overtime parking at meters or for any other violation of parking involving meters maybe settled by payment, not later than 7;00 P. M. on the day upon which such notice is given, of the sum of Fifty (50C) for each violation notice, which payment shall be in complete satis- faction of the offense. Payment of such notice to be made by dropping the traffic violation notice or notices, together with the required minimum penalty or penalties into one of the payment boxes provided for such purpose and found attached to meters at various places upon the streets within the town, or by paying to such persons at police headquarters as from time to time shall be designated by the town manager to receive such payment, or by mailind the required amount of money for such minimum penalty, together with traffic violation notice or notices to the police department upon the same day such violation notice was received. Cancellation date upon mail received shall be conclusive evidence as to the time when such traffic violation notices were placed in PARKING the mail. ORDINANCE In the event traffic violation notices are not paid as above indicated, but pair thereafter and within five days of the date upon which the notice was given, then they may be paid at police head- quarters for a minimum penalty of two dollars and fifty cents. The failure of any person to pay such traffic violation notices as above provided shall result in the issucance of a summons on such notice and the offense being treated as a misdemeanor, and punishable in like manner as provided for punishment of misdemeanors under the laws of the state. Traffic violation notices given for nonmoving parking violations other than those involving parking meter violations, may be settled by payment thereof within twenty-four hours from the time the traffic notice is given, for the following sums: FOR: Overtime in limited area Parked in prohibited area Parked on sidewalk Overtime in loading zone Blocking Driveway More than eighteen inches Parked within fifteen feet Improper parking $ .50 2.00 2.00 1.00 2.00 from curb 1.00 of fire hydrant 3.00 1 .00 Payment of the aforesaid notices may be made by dropping the payment in the boxes attached to meters, by payment at the police headquarters or by mailind the required amount of money for such minimum penalty, with the traffic violation notice, to the police department within twenty-four hours of the time the notice was received as provided above for parking meter violations. In the event nonmoving traffic violations other tha parking meter violations are not paid within twenty-four hours, then the official dseignated by the town manager shall proceed under the provisions of Section 16-19 and shall collect such penalty as provided in this section, plus additional costs to the town for giving the required notice. In the event payment is not made within a five-day period, then a warrant shall be issued and served upon such violator in the regular manner for execution of warrants. s9ss 6987 September 1, 1981 It shall be the duty of the town manager, and he is hereby authorized, to set up, provide necessary tickets, summons, etc., establish and publish a full and complete procedure for handling traffic violation notices, and for such other procedure as he may deem necessary, and he shall xend~~ reports on compliance thereof at such times as he may deem it wise. This ordinance shall become effective on the 1st day of October, 1981. All amounts paid under this section to be credited to and become a part of the general fund of the town. Councilman Aust advised the Committee had reviewed the suggestion of Councilman Wallace that the Town discontinue designating STUDY RECOMMDS zhe number of cabs. to operate in the Town, as well as setting the COUNCIL CONTROLS NUMBER OF rates; but after considering a study made by the League Office on TAXICABS AND RATES IN USE how the near-by towns handle this situation, the Committee recommended there be no change in our present ordinance, ,and so moved. Neblett, Jr. -Aye Councilman Aust advised it was the recommendation of the Ordinance Committee, and he so moved, that there be an increase ORDINANCE TO BE PREPARED of 25C per trip, from the present $1.65 to $1.90, be granted Blue FOR INCREASE IN TAXICAB RATE & White Cabs, and that an ordinance be prepared for Council's considera- tion. PROPERTY TAXES BEFORE ISSUANCE OF NEW AUTO LICENSES AND APPLIES TO LEVIES AGAINST VEHICLES proposal from Pulaski County whereby payment of personal property taxes for both County and Town be made before the issuance of Town or County motor vehicle tags, and recommended, and he so moved, that a proper ordinance be prepared. Motion was seconded by Councilman Graham. Town Attorney Moore advised this. does not apply to payment of all personal property taxes, only levies against the vehicle for which the tags are being secured. Neblett, Jr. - Aye i~ u I, h September 1, 1981 POLLUTION & SANITATION COMMITTEE 6988 As the Town's representative on the Environmental Quality Committee REFER MATTERS TO TOWN MGR. of the Municipal League, Councilmember Holston referred two legislative FOR REPORT matters to Town Manager Coake for his study and recommendation. SAFETY COMMITTEE Chairman Neblett reported there was no report for the Safety Committee. Mr. Neblett advised the Personnel Committee met and considered the ACCEPT BID OF MACCABEES INS. FOR EMPLOYEE LIF E INS . & TOWN MGR. TO EXECUTE NEC. PAPERS bids received on the Group Life Insurance and Accidential Death & Dis- memberment Coverage. The lowest bid was submitted by Maccabees Insurance Company, at a rate of $.39/$1000 coverage for life and $.05/$1000 coverage for A.D. & D. The present rate being $.56/$1000 and $.06/$1000, respectively. It was the recommendation of the Committee that the low bid of Maccabees Insurance Company be accepted, and that Town Manager Coake be authorized to execute the insurance contract and related papers, dated October 1, 1981, and so moved. Neblett, Jr. - Aye REPORT OF MAYOR Mayor Ratcliff furnished Council members with copy of the Resolution adopted August 4, 1981 relative to an agreement between Mr. Ginsburg and the Town of Pulaski to take in "L Place" at Macgill Village, and also MAYOR'S REPORT copy of correspondence requesting a five foot right-of-way. This was ON L PLACE & MR. GINSBURG discussed as well as the cost involved, and on motion of Councilman Graham, seconded by Councilman Aust, it was referred to the Finance Committee to report on the actual cost relative to the take over of "L Place:. Motion carried. Mayor Ratcliff advised he had been co ntacted relative to the establish- REQUEST ment of a cross-walk on East Main Street from approximately TV Cable office CROSS WALK ON E. MAIN to the Parking Lot on the South side of East Main Street. ST . REF . TOWN MGR. Councilman Neblett moved that the request for a cross-walk on East Main Street be referred to Town Manager Coake for a recommendation to Council. Motion was seconded by Councilman Boyd, and carried. s9s9 September 1, 1981 REPORT OF TOWN MANAGER Town Manager Coake advised that an application had been received TRAILER APPLICA_ OF R.L. from Roger L. Pennington to place a mobile home at 1034 Garner Avenue. PENNINGTON TO BE ADVERTISED Councilman Graham moved this application follow the normal procedure for FOR PUBLIC HEARING applications of this kind. Motion was seconded by Councilman Boyd, and carried. LABOR DAY Town Manager Coake advised the Town Offices would be closed C 1.0 S ING for Labor Day, September 7th. Town Manager Coake advised that H. B. Childress had been CHILDRESS elected President of the Virginia Section of Chiefs of Police, and Council- ELECTED man Neblett moved that the Town Attorney be directed to prepare a PRESIDENT VA. SEC.
