HomeMy WebLinkAbout12-01-81'7028 Minutes of the regular meeting of the Pulaski Town Council held December 1, 1981, at 4:00 P, M, in the Council Chambers in the Municipal Building. There were present: Vice Mayor Andrew L, Graham, Jr ., presiding in the absence of Mayor Ratcliffe. Councilmembers: Glen K. Aust, Alma H, Holston, C. E. Boyd, Jr. James M. Neblett, Jr,, Robert M. Wallace, John A. Johnston, Pauline G. Mitchell Also present: H, R. Coake, Town Manager Gladys R. Dalton, Clerk Garnett S, Moore, Town Attorney Roger A. Williams, Treasurer Visitors: Dee Lindsey and Doug Waters of the news media Vicki Futrell, Pulaski County Chamber of Commerce E. V. Davis and Herman Largen The invoation was given by Councilman Aust, who requested INVOCATION that a moment of silence be observed in respect for Samuel G. Frye, who recently died, and who served on the Town Council for many years. The minutes of the special meeting of November 17, 1981 and APPROVE regular meeting of December 17, 1981 were approved as corrected. MINUTES Vice Mayo: Graham advised this was the time and place, as had been advertised in the local newspaper, for Council to hold its annual PUBLIC HEARING TAXICAB public hearing as required under Chapter 26 of the Town Code, for the purpose of determining the number of public vehicles, taxicabs and for hire cars for which certificates shall be issued during the calendar APPLICATION FOR 18 year 1982, CERTIF ICATES Town Manager Coake advised that applications had been received from E, V. Davis, t/a E. V. Davis Cabs, for one (I) Certificate;;Chas. W, Matherly, t/a Deluxe Cabs, for two (2) Certificates, and Herman G, Hargen, t/a Blue & White Cabs for Fifteen (15) Certificates - making a total of 18 certificates, which is one less than the number of certificates granted by Council for the year 1981. Mr, E, V. Davis advised that his business had dropped off since the rate increases granted by Council, and asked the ceiling be dropped E.V,DAVIS to take care of the poor people. Mr, Davis stated he felt if others FAVORS LOWER TAXI wished to undertake the taxicab business, their applications should be RATES & COMPETITION considered; he felt competition was good and opposed a "tie-up" in the taxicab business. "~~~~ December 1, 1981 Mr. Herman Largen advised he would like to have his LARGEN ASKS request for .fifteen certificates granted, and that he felt he was FOR 15 CERTIFICATES providing service for the people in Pulaski and that the present rates were lower than in other towns, that he had tried to provide the best service possible. Councilman Wallace reported he had been charged different COUNCILMAN rates on two trips to his home on Deerfield Drive. Mr. Wallace WALLACE REPORTS DIFFERENT also brought to the attention of Council the three cabs being parked RATES FOR SAME TRIPS behind the Blue & White Cab Station, stating that he felt if the Town has ordinances covering these instances, they should be enf orced. Mr. Largen advised that as soon as psrts are taken from the old taxicabs, to ,which Mr. Wallace referred, they would be re- moved from the lot. PUBLIC HEARING ENDED Vice Mayor Graham declared the public hearing closed. Councilman Boyd moved that eighteen (18) Certificates be 18 CERTIFICA- granted for the calendar year 1982. Boyd, Jr. - Aye James M, Neblett, Jr. - Aye Councilman Boyd moved that Certificates be granted to the following companies for the year 1982: .Blue & White Cabs - 15; APPROVED CERTIF ICATES E, V. Davis Cabs - One; and Deluxe Cabs Two (2), making a total of eighteen (18) Certificates. Motion was seconded by Councilman Neblett, and carried on the following vote: John A. Johnston - Aye Andrew L. Neblett, Jr. - Aye Vicki Futrell, Director of the Pulaski County Chamber of Commerce gave a report on the activities of the Chamber relative CHAMBER OF COMMERCE REPORT to matters concerning the Town, and stated the Chamber would continue to work with the Council for the betterment of the Town. She ex- pressed appreciation for the cooperation of Town Manager C oake, and other Town officials. December 1, 1981 UTILITIES COMMITTEE Chairman Johnston had no report other than he and Mayor ATTEND MEETING OF PEPPERS FRY. AUTHORITY i` Ratcliffe had attended the last meeting of the Peppers Ferry Regional iiastewater Treatment Authority. RECREATION COMMITTEE Chairperson Mitchell reported the Committee met November 30th and it was the recommendation of the Committee that the money taken in '~03U $1763.50 from softball tournaments at Loving Field, the sum of $1763.50, be REC' D FROM TOURNAMENTS used for fencing the mini-fields. Councilman Graham, Chairman of the TO BE HANDLED ADMINISTRA- Finance Committee, advised that his Committee had considered this and TIVELY; FENCING OF MINI-FIELD it was felt the spending of the $1763.50 could be handled administratively. STREET COMMITTEE Councilman Wallace asked that an executive Session on a legal matter be held at the conclusion of the business of Council. Councilman Wallace stated the Street Committee had consider- ed the Pulaski Area 2000 Transportation Plan developed by the Virginia Department of Highways and Transportation, and moved it be accepted. Neblett, Jr. - Aye i,AND AND BUILDING COMMITTEE Chairman Boyd advised that his Committee had reviewed the . Rules and Regulations, as well as rates charged for use of the Armory,. COUNCIL and it was the recommendation of the Committee that the following RULES & REGULATIONS changes be made: FOR ARMORY RENTAL Item 12 be added to state: It is the responsibility of the Lessee to leave the Armory in a clean condition. A $25.00 charge will be made when the property is rented, said charge to be returned to the renter if the Armory is left in a clean condition. Item 5 will be changed to read: Rental rates outlined in Item 4 will also apply to time required to use the Armory to "set up" and "take down" any equipment, displays, or other facilities that may be required. Item 4 will be changed to read: When not otherwise used by the National Guard Armory Unit, and when non-conflicting dates are available, the Armory may be rented for legitimate community purposes at the rental fees prescribed as follows: ~703~ December 1, 1981 (1) Where no admission charge is made and is not a commercial activity for the purpose of making profit: a, For the main auditorium $50 per day/24 hours -k b. Councilman Boyd moved that the above Rules and Regulations and Rates be adopted for use of the National Guard Armoy. Motion was seconded by Councilman Aust, and carried. CABLE FRANCHISE FINANCE COMMITTEE Chairman Graham reported the Finanne Committee met and considered several matters, one of which was a statement from the APPROPRIATES Highway Department. Councilman Graham moved that $2,422,91 be $2,442.91 FOR PAYMENT TO appropriated to Account ~k900-931.0 - Memorial Drive and Other HWY. DEPT. MEMORIAL DR. Rights of Way from General Fund Unappropriated Surplus, and payment be issued to Virginia Department of Highways per current billing. Town Attorney Moore advised that the Planning Commission ordinance is just about completed, but more work is needed on the Fire Department Ordinance. SAFETY COMMITTEE Chairman Neblett advised the Committee has not forgotten about the establishment of a Patrol System, and that Chief Childress is attend- CHIEF CHILDRESSing a meeting and it was hoped he could bring back some inf ormation for TO REPORT ON PATROL the Committee to review concerning this Patrol System project. SYSTEM ON RETURN FROM Councilman Neblett advised there were several appointments and MEETING reappointments necessary for the various Committees of Council and ATTORNEY gave Town Atprney Moore a list for the preparation of a Resolution-„ TO PREPARE RESOLUTION stating that all had been contacted and agreed to serve. Vice .Mayor Graham stated Mayor Ratcliffe was attending MAYOR ATTENDING MEETINGS meetings in Detroit and Washington, and would-be making a report to Council on his return. TOWN ATTORNEY MOORE Town Attorney Moore stated the Council had received a request from Meredith & Tate, Inc, and Jefferson Mills, for a permit to construct cables or wires across LaGrange Street, ADOPTION and in order to follow through with this request, presented OF RESOLU- TION RE: and read to Council a Resolution setting forth the procedures MEREDITH & TATE REQ. necessary as provided in Section 15.1-431 of the Code of Virginia, as TO CONSTRUCT CABLES OR WIREamended. OVER LAGRANGE STREET Councilman Aust moved the adoption of the Resolution as ~°tead by Town Attorney Moore. Motion was seconded by Council- man Boyd, and carried on the following vote: John A. Neblett, Jr. - Aye RESOLUTION ,WHEREAS, a request has been received from Meredith & Tate, Inc., and Jefferson Mills, dated November 16, 1981, for a permit to construct coax cables or wires over LaGrange Street in the Town of Pulaski, Virginia, from the top of Jefferson Mills building to the top of the,Meredith & Tate, Inc., building to allow Meredith & Tate, Inc., to use the computer and computer services of Jefferson Mills; and RESOLUTION WHEREAS, no ordinance granting permission as requested can be adopted prior to holding a public hearing before the Council and Planning Commission of the Town, said public notice to be given as provided in Section 15.1-431 of the Code of Virginia of 1950, as amended. • NDW, THEREFORE, BE IT RESOLVED by the Council of the Town of Pulaski, Virginia, meeting in regular session on this 1st day of December, 1981, that: (1) The request of Meredith & Tate, Inc., and Jefferson Mills be and it is hereby received and ordered filed. (2) That a joint hearing between the Council and the Planning Commission of the Town of Pulaski be held at 4t 00 o'clock P. M., in the Council Chambers on the 5th day of January, 1982. (3) That proper notice be mailed to adjacent property pwners and a public notice be placed in the Southwest Times to be published on the 21st day and the 28th day of December, 1981. December 1, 1981 REPORT OF TOWN MANAGER Town Manager Coake advised that a request had been 7034 J.W.EARLY received from John W. Early, who was 63 years of age October 21, 1981, RETIREMENT EXTENDED TO and desired early retirement effective January 1, 1982. JAN 30, 1982 Councilman Boyd moved that John W. Neblett, jr. - Aye Town Manager Coake advised he had received good responses relative to the Training Seminar held at the Armory on November 4th and SUCCESSFUL 5th for Supervisory personnel, and it was hoped this type activity TRAINING SEMINAR could be repeated on a regular basis. The instructors were employees HELD AT ARMORY of the Virginia Department of Personnel and Training. Mr. Coake advised a Fisheries report on Gatewood Reservoir by the Virginia Commission of Game and Inland Fisheries had been GATEWOOD REPORT completed and copies had been made available to the members of ON FISHERIES Council. At 5:15 P. M. Councilman Wallace moved that Council go into EXECUTIVE SESSION Executive Session on a legal matter. Motion was seconded by Council- man Boyd, and carried. At 5:56 P. M. Council returned to Regular Session, and REGULAR Councilman Neblett moved that Council adjourn. Motion was SESSION & seconded by Councilmember Holston, and carried.
