Councilmen present: Bob Wallace, John A..Johnston, Andrew L. Graham, Jr., B1air;B. Brockmeyer, William A. House, Arthur L. Meadows Also present: James E. Marshall, Town Manager Garnett Moore, Town Attorney Raymond F. Ratcliffe, Mayor Rite Bratton, Acting Clerk of Council Absent: C. E. Boyd and James Neblett Visitors: Barbara English, Roanoke Times Dave Vascek, Southwest Times Rich Kerns, WPUV Before the start of the meeting Mayor Ratcliffe distributed Letters of Intent allowing each Council member time to review the LETTERS OF INTENT Letters before the meeting was called to order. The Letters referred HANDED TO MEMBERS to consideration of a contractural agreement between the Town of Pulaski, OF COUNCIL Town of Dublin, Pulaski County, and the Pulaski County Public Service Authority relating to the ownership and operation of the pipe line laid to the Pepper's Ferry Regional Wastewater Treatment Plant. At 5:10 P. M. The Council meeting was called to order by Mayor Ratcliffe. The invocation was given by Councilman Graham. Mayor Ratcliffe brought to the attention of the Council that Rita Bratton should be made Acting Clerk of Council in the absence of RITA BRATTON Mrs. Gladys Dalton. Councilman House moved that Rita Bratton be made APPOINTED ACTING CLERK Acting Clerk of Council for this meeting, seconded by Councilman Wallace and so carried. Mayor Ratcliffe read the Waiver of Notice of Special Council meeting. L 1 March 12, 1980 O~~J.~ WAIVER OF NOTICE OF SPECIAL COUNCIL MEETING We, the undersigned duly elected members of the Council of the Town of Pulaski, Virginia, hereby waive notice of a Special Meeting of said Council at 12:00 o'clock Noon on the 14th day of March, 1980, for the >_ purpose of considering and approving a letter of intent regarding the trans- mission lines between Pulaski and the Pepper's Ferry Regional Sewage Treatment Plant, and any other business that may legally come bef ore the Council. WITNESS our signatures this 14th day of March, 1980, 1 Letter of INTENT NEEDS CHANGES There was a discussion held concerning the Letter of Intent and the changes needed bef ore the Letter would be acceptable. No action was taken at this time. At 5:45 P. M. Councilman Graham moved to go into Executive Session EXECUTIVE SESSION to discuss a legal matter. The Mayor asked the motion be rescinded until discussion of the Letter of Intent was completed. an The Council agreed to use this Letter of Intent as/outline to go I ~~ COUNCILMEN by. Each Councilman was to make any suggestions regarding the Letter in memorandum form, attaching them to the Letter, and returning them to the TO MAKE Mayor. Mr. Moore and Mr. Dow Owens would then work together to make SUGGESTIONS IN LETTER OF any changes and "break the letter down" into a lessor form bef ore sending INTENT & RET. TO MAYOR the letter to the State Water Control Board. ~~~~~ March 12, 1980 At 6:22 P. M. Councilman Graham moved Council go in Executive EXECUTIVE SESSION Session to discuss a legal question. Seconded by Mr. Meadows, and so carried. At 6:55 P. M. Councilman House moved Council return to REGULAR SESSION regular session. Seconded by Councilman Graham and so carried. At 6:56 P. M. Mayor Ratcliffe declared Council back into Regular Session and inquired of any other business. At 6:57 P. M. Councilman Graham moved Council recess until COUNCIL RECESSED Monday, March 17, 1980 at 5:00 F. M. The meeting was recessed by Mayor Ratcliffe. There were present: Mayor Raymond F. Ratcliffe, presiding. Councilmen: Andrew .L. Graham, Jr., William A. House, John A. Johnston, Robert M. Wallace, James M. Neblett, Jr., Blair B. Brockmeyer, Absent: Councilman C. E. Boyd, Jr., and Councilman Arthur L. Meadows Also present: J. E. Marshall, Town Manager Gladys R. Dalton, Clerk Garnett S. Moore, Town Attorney Visitors: Rick Kerns and Dave Vascek of the media The invocation was given by Mayor Ratcliff. Mayor Ratfliffe stated the purpose of the called meeting was to SPECIAL MEETING consider and approve a Letter of Intent regarding the transmission lines TO APPROVE LETTER OF INTENTbetween Pulaski and the Pepper's Ferry Regional Wastewater Treatment Plant, and called on Garnett Moore, Town Attorney, to give Council a Legal LEGAL interpretation of the Letter. Mr. Moore advised the Letter indicates the INTERPRETATIONTown of Pulaski will participate in the Pepper's Ferry project and does not commit the Council to any one "plan" for financing the project, but that some agreement for this would be worked out later on. The Letter of Intent was then reconstructed that it was agreed LETTER that the Town of Pulaski and the County of Pulaski would own and operate RECONSTRUCTED jointly or severally the force main line and pump station running from Pulaski to the Town of Dublin. Further, that the Town of Pulaski, the Town of Dublin and the County of Pulaski would own and operate jointly or severally the gravit}~ line running from Dublin to the equalization basin in Fairlawn. The Letter also stated that details and percentages of the owner ship and operation would be established in detail in a contract to be prepared for review and agreement by the respective jurisdictions. Following more discussion, Councilman Johnston moved that Council authorize Mayor Ratcliffe to sign the agreement as Mr. Moore has re- AUTHORIZI: MAYOR TO constructed it and send same to the County of Pulaski and Town of Dublin SIGN AS OUTLINED BY for their comments and signatures.
