HomeMy WebLinkAbout03-14-800592 Minutes of a Special Meeting of the Pulaski Town Council held at 12 o'clock Noon March 14, 1980 in the Council Chambers in the Municipal Building. There were present: Mayor Raymond F. Ratcliffe, presiding. Councilmen: Andrew L. Graham, Jr., William A. House, John A. Johnston, Robert M. Wallace, James M. Neblett, Jr., Blair B. Brockmeyer, Absent: Councilman C. E. Boyd, Jr., and Councilman Arthur L. Meadows Also present: J. E. Marshall, Town Manager Gladys R. Dalton, Clerk Garnett S. Moore, Town Attorney Visitors: Rick Kerns and Dave Vascek of the media The invocation was given by Mayor Ratcliff. Mayor Ratfliffe stated the purpose of the called meeting was to SPECIAL MEETING consider and approve a Letter of Intent regarding the transmission lines TO APPROVE LETTER OF INTENTbetween Pulaski and the Pepper's Ferry Regional Wastewater Treatment Plant, and called on Garnett Moore, Town Attorney, to give Council a legal LEGAL interpretation of the Letter. Mr. Moore advised the Letter indicates the INTERPRETATIONTown of Pulaski will participate in the Pepper's Ferry project and does not commit the Council to any one "plan" for financing the project, but that some agreement for this would be worked out later on. The Letter of Intent was then reconstructed that it was agreed LETTER that the Town of Pulaski and the County of Pulaski would own and operate RECONSTRUCTED jointly or severally the force main line and pump station running from Pulaski to the Town of Dublin. Further, that the Town of Pulaski, the Town of Dublin and the County of Pulaski would own and operate jointly or severally the gravity line running from Dublin to the equalization basin in Fairlawn. The Letter also stated that details and percentages of the owner+ ship and operation would be established in detail in a contract to be prepared for review and agreement by the respective jurisdictions. Following more discussion, Councilman Johnston moved that Council authorize Mayor Ratcliffe to sign the agreement as Mr. Moore has re- AUTHORIZE MAYOR To" constructed it and send same to the County of Pulaski and Town of Dublin SIGN AS OUTLINED BY for their comments and signatures. Motion was seconded by Councilman ATTORNEY Neblett. y~~93 March 14, 1980 Councilman Graham made a substitute motion - Moved that Council reconvene on Monday, March 17, 1980 at 5:00 P. M. to SUBSTITUTE review the final document. Motion was seconded by Councilman MOTION DID NOT CARRY House, and the following vote was taken: Andrew L. Graham, Jr. - Aye William A. House - No Blair B. Brockmeyer - No C. E. Boyd, Jr. - Absent Robert M. Wallace - Aye Arthur L. Meadows - Absent John A. Johnston - No James M.Neblett, Jr .- No A vote was then taken on the original motion: James M. Neblett, Jr. -Aye John A. .Johnston - Aye Arthur L. Meadows - Absent Robert M. Wallace - Aye C. E. Boyd, Jr. - Absent Blair B. Brockmeyer - Aye William A. House - Aye Andrew L. Graham, Jr.- Aye Motion carried. WAIVER OF NOTICE OF SPECIAL COUNCIL-MEETING We, the undersigned duly elected members of the Council of the Town of Pulaski, Virginia, hereby waive notice of a Special Meeting of said Council at 5:00 P. M. on the 12th day of March, 1980, for the purpose of considering the agreement between the Town of Dublin, Pulaski County and the Pulaski County Public Service Authority concerning the sewer line between Pulaski and the Fairlawn Interceptor, and any other business that may legally come before the Council.
