HomeMy WebLinkAbout08-16-776040 Minutes of the regular meeting of the Pulaski Town Council held August 16, 1977 at 7:00 P. M. in the Council Chambers in the Municipal Building. There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: John A. Johnston, C. W. Wickam, Jr ., William A. House, Blair B. Brockmeyer, Arthur L, Meadows, James M. Neblett, Andrew L. Graham, Jr., Bob J. Clark Also present: Town Manager: J. E. Marshall Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore Town Treasurer: Roger Williams Visitors: Jane Graham, WPW Radio Station J. R. Schrader, The Southwest Times Frances Martin - Macgill Village The invocation was given by Councilman Neblett. The minutes of the last council meeting were corrected to MINUTES APPROVED show the meeting date of August 2, 1977, and were then approved as recorded . Frances Martin of L Place Macgill Village appeared bef ore Council regarding the poor condition of the street at L Place in the Village. Town Manager Marshall advised that the only street in the Village that is a public street and for which the Town is responsible for maintenance is Floyd Lane; that all the other streets are privately owned by the Macgill Village Company, and these residents would have to look to the Macgill Village Company for repairs to the streets. STREET COMMITTEE Town Attorney Garnett Moore advised this situation is still TO STUDY MACGILL bef ore the Council and has been under discussion since Annexation; that VILLAGE STREET Mr. Ginsburg presented this matter to the Council and was advised that SITUATION the Council would take it under consiueration. Mr. Moore further stated it is a matter the Council, as far as policy, must decide whether it will take these streets into the town's street system. Mr. Moore stated he felt that Mr. Ginsburg would give the Town an easement for the installation of water and sewer lines. Councilman Neblett moved that this matter be placed under "Pending Projects" on the Council agenda, to clarify same. Neblett - aye Councilman House moved the matter of streets in Macgill Village be referred to the Street Committee for recommendation to the Council. C-lark - aye Blair B. Brockmeyer - aye Arthur L. Meadows - aye John A. Johnston - aye James M. Neblett - aye Mayor Ratcliff called for reports of the Committees. Councilman Hickam had no report. Mr. Hickam brought to the REQ . TO TRIM attention of Town Manager Marshall the need for trimming of trees on TREES ON PROSPECT Prospect Avenue. Councilman Graham had no report. Councilman Brockmeyer stated he noticed from the Town Manager's Administrative Report that the Department of Health - Bureau of Solid Waste and Vector Control, had issued to the Town a non-conf ooming permit PERMIT- f or the operation of the sanitary landfill on Draper Mountain. LANDFILL Councilman Brockmeyer also brought out the fact that he had been receiving calls relative to the noise in the vicinity of Brown Gables. NO IS E COMPLAINTTown Manager Marshall advised that the Police Department is aware of this BROWN GABLES situation and is watching it in an effort to do something about it. Mayor Ratcliff reported on the bad conduct of persons frequenting the Dora Highway Park, both day and night, and there was dis cussion concerning BAD some solution to these various problems. Town Manager Marshall suggested CONDUCT IN PARKS that Council give some consideration to this even on a seasonal basis. Councilman Hickam moved it be ref erred to the Ordinance Committee. The motion was seconded by Councilman Clark, and carried. Councilman Johnston had no report. .Town Manager Marshall stated that after sending out the Administrative CETA Report on Friday, inf ormation was received that the CETA Grant would be coming GRANT COMING through for the Senior Citizen Center, and it was hoped to have something THROUGH on this soon so work could be started on the building renovation. 6042 August 16, 1977 Councilman House stated that he had read on the back of the permit for the landfill operation "this will permit the Town of Pulaski a reasonable time to relocate another site". Mr. House inquired if this had ref erence to the leachate or something other than the Town is now doing? Town Manager Marshall stated it is primarily referring to the leachate, to bring it into compliance with the State regulations, and it was his feeling that the Town could continue its operation in the purview of the regulations. Councilman House stated Council had approved in the Budget under Revenue Sharing9~ccount, the purchase of two dump trucks, and asked Council's approval of the expenditure. Mr. House moved that the Council approve the expenditure of the Budget Revenue Sharing item - Account ~~4069 for two (2) Dump Trucks for the Public Works Department, in the amount of $25,000.00. Neblett - aye DEPARTMENT , Councilman House further reported that the Finance Committee met a week ago with Town Manager Marshall and Finance Director Roger Williams and it appears the Town must seek a temporary loan to operate at this particulat time inasmuch as the cash income does not TEMP. LOAN NECESSARY exceed the amount of money going out. Mr. House stated Council FOR CASH FLOW & should authorize Town Attorney Moore to prepare the necessary SPECIAL MEETING papers to borrow from the local banks an amount not to exceed $200,000 SET FOR AUG. 23RD f or 120 days. He further stated a payment on the Street bQ~nds and interest would be coming due the first of September and there were not enough funds in the bank or coming in to take care of this, and that approximately $180,000 was necessary to carry the Town through this period. Mr. House further stated that next June, at budget preparing time, the Council must consider a method of increasing income to the Town if the Town continues to take care of the services now being rendered. August 16, 1977 Councilman House moved that a special Council meeting be held at 12 o'clock Noon, Tuesday, August 23, 1977, for the purpose of SPECIAL MEETING considering a temporary loan to meet the needs of the Town at this AUGUST 23RD time. Neblett - aye Councilman Clark had no report. f 443 At this time Councilman Graham asked Mr. Clark about a report on who is benefiting from the Town's Recreation Program. Town Manager SURVEY KEPT ON RECREATION Marshall advised that a survey has been kept on the summer activities, PARTICIPATION, SIMILAR and he felt that by the next meeting of Council a report could be made SURVEY TO BE MADE ON on the summer activities for this year. Mr. Graham was of the opinion SENIOR CiENTER that such a survey should be kept on the participation at the Senior Citizen Center. Councilman Meadows had no report. Mr. Meadows stated he had talked with two of the taxicab operators relative to a rate increase NO REPORT ON TAXICAB and the possibility of installing meters, but that he had not been able ORDINANCE to contact the third owner, and felt this should be done before making a report to the Council. Councilman Neblett had no report. Mayor Ratcliff advised that the Town had been informed that the Town has had another year of "Safety" as far as pedistrians are con- CHILDRESS TO RECEIVE cerned, and a presentation will be made by Governor Godwin. Mr. Marshall AWARD FOR TOWN RE: stated that Chief Childress will represent the Town at the presentation PEDESTRIAN SAFETY by the Governor. Town Attorney Moore advised that recently he discussed with Council and gave them inf ormation relative to joining NIMLO in the case concern- ing Unemployment Compensation by Municipalities, and if Council intends COUNCIL TO CONSIDER to join in this case the deadline is September 1st. Councilman House JOINING NIMLO moved this item be placed on the agenda for the special meeting of Council on Tuesday, August 23rd. The motion was seconded by Councilman Hickam, and carried. 60~ + August 16, 1977 Town Manager Marshall advised Council that the Virginia BECAUSE OF Municipal League meeting to be held in Williamsburg is in conflict LEAGUE MEETING with the second monthly meeting of Council in September, which falls TOWN COUNCIL MEETING FOR on the 20th, and suggested that the meeting be rescheduled from the AUG. 20TH RE- SCHEDULED FOR 20th of September to the 21st of September in order to have some AUG. 21ST continuity in the Council meetings. Neblett - aye Town Manager Marshall reported that inf ormation again has been received regarding the designation of the voting delegate and the alternate voting delegate for the Town at the League MAYOR VOTING Convention's business session on Tuesday, September 20; that it was DELEGATE AT LEAGUE MEETING, necessary that this inf ormation be submitted to the League office. VICE MAYOR GRAHAM ALTERNATE Councilman House moved that Mayor Ratcliff be designated as the voting delegate for the Town of Pulaski at the business session on Tuesday, September 20th, and that Vice Mayor Andrew Graham be designated as alternate. The motion was seconded by Councilman Brockmeyer, and carried. Town Manager Marshall advised that information had been received from the State Water Control Board which indicates that REQ. SUBMITTED they have approved and submitted to EPA the request that the scope T 0 EPA FOR EXPANDED COST be expanded and the cost theref or increased for the Step I Grant IN STEP I GRANT C l Amendment to the Sewage Treatment Plang Expansion Project, and it is assumed that the Town or the State Water Control Board will have to obtain concurrence from EPA to expand the scope of the Step I Grant. At this time, however, no approval has been received from the State Water Control Board with regard to the cost overrun. Mr. Marshall stated it was believed the State Water Control Board wanted to separate out from the Grant increase with regard to the single service area concept study rather than clouding the issue with that particular matter in order that the study of the single service area can proceed as soon as possible. Town Manager Marshall reported that official word has been August 16, 1977 received from the State Water Control Board that the plans and specifications for the sanitary sewer line extension under the Community Development Block Grant has been appreved in their entirety. He stated a pre-bid conference has been held and the bid opening date has been set for August 19, 1977; however, no contract will be awarded at that time inasmuch as the Engineering 6045 staff will need approximately two weeks to evaluate all bids submitted with the alternates in order that a complete picture may be documented and presented to the Council at their meeting on September 6th. Town Manager Marshall reported an application from Moses Webb, Jr and Oscar M. Smith to operate a dance hall at 170 West Main Street has PUBLIC been received. Mr. Marshall HALL PERMIT recommended that a public hearing be scheduled on the application for September 6th Council meeting. Councilman Clark so moved, seconded by Councilman Meadows, and carried. Town Manager Marshall reported an application from Calvin C. Duncan for permission to place a mobile home on Herron Street had been PUBLIC received, and recommended this follow the normal procedure and a public HEARING hearing be scheduled for the September meeting of Council. Councilman ON TRAILER Clark so moved, seconded by Councilman Graham, and carried. Mr. Marshall reported that responses from members of our staff WASHINGTON and outside agencies have been received relative to the Washington Square SQUARE PROJECT Project, and this inf ormation will be forwarded on to HUD for their consideration, together with comments from the Council. Town Manager Marshall stated that at the last meeting of Council a summary of the 1977 tax report as prepared by Finance Director Roger Williams was presented to the Council with the recommendation that it be considered for action at this meeting. COUNCIL CONSIDERS At Council's meeting on August 2, 1977 copies of the 1976 TREAS .' DEL. Delinquent Tax report of Finance Director-Treasurer Roger Willisns TAX REPORT were furnished to the Mayor and members of the Town Council. TAX REPORT On motion duly made by Councilman Clark, and seconded by Councilman Brockmeyer, and carried on the following unanimous-vote, the following Resolution was adopted: (all AYES) BE IR RESOLVED that the above set out the Town Treasurer's report for delinquent taxes for the year 1976, as certified to the Council, be accepted; that the Treasurer be credited with the amount shown to be delinquent and that said List of delinquent real estate tax be filed with the Clerk of the Circuit Court of Pulaski County, Virginia, to be recorded and indexed by him; that a list containing all unpaid real estate taxes as of June 30, 1976, to be published in a local newspaper on August 28, 1977, that a list of unpaid personal property and any and all other taxes be prepared.; that such lists be posted at the Courthouse and other public places all said proceedings to be in accordance with the provisions of the Code of Virginia, 1950 Edition, Title 58, Chapter 20, Article 7, and Chapter 21, Article 7, and all applicable amendments to the said code. Pursuant to Statute, the Treasurer of the Town of. Pulaski submitted to Council a list of improper and erroneous assessments of taxes for the consideration of said Council, as follows: Whereupon, on motion duly made by CouncilmanClark, seconded by Councilman Meadows, and carried on the following recorded vote, the following Resolution was adopted: C. Neblett - aye ~1 august 16, 1977 BE IT RESOLVED, that the Treasurer's list of improper and erroneous assessments for taxes for the year 1976 be submitted to the Commissioner of Revenue for further verification; that when same has been verified by the Commissioner of Revenue for Pulaski County, Virginia, as being improper and erroneous, the Town Treasurer is hereby directed to correct tax tickets accordingly and the said Treasurer is hereby relieved from the duty and responsibility of collecting same. Williams is hereby relieved from the duty and responsibility of collecting same.
