HomeMy WebLinkAbout01-21-75J~ Minutes of the regular meeting of the Pulaski Town Council held January 21, 1975 at 7:00 P M. in the Council Chambers in the Municipal Building. There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: C. William Hickam, Blair B..Brockmeyer, Mason A. Vaughan, William A. House, Bob J. Clark, Arthur L. Meadows, James M. Neblett, Andrew L. Graham Also present: Town Manager: J. E. Marshall Clerk:. Gladys R.,Dalton Town Attorney: Garnett S. Moore Visitors: J. R. Schrader ,Southwest Times reporter Debbie Hudson, WBLB Radio Station Morris Burton - New River Valley Rescue Squad Paul Roop and Jesse Hopkins The invocation was given by Councilman House. The minutes of the regular meeting of January 7th were approved as recorded. Mayor Ratcliff advised this was the time and place as advertised in the local newspaper for holding a public hearing on the application of Mrs. Cecil Jacobson to place a house trailer on Lot 41E, Block 57-E, 215 Henry Avenue, and Council would be MRS. CECIL JACQBSON glad to hear any one who wished to speak against this TRAILER REQ. APPROVED UNDER aPPlication, or any one who wished to s"peak iri favor of CERTAIN CONDITIONS Placing a trailer at this location. No `one spoke either for or against the application. Town Manager Marshall stated the square footage of the lot on which the single dwelling now exists is 20,016 feet, which is sufficient to subdivide into two lots and provide the required 10,000 square feet for the dwelling and the trailer. Mr. Marshall stated there were no objections from adjacent property owners; water and sewer is available, and recommmended that the application be approved subject to the land being subdivided into two lots contairiing'~0,000 square feet each, and the plat being approved by the Planning Commission. Councilman House so moved, which motion was seconded by Councilman Neblett. Also discussed was the fact that the ~`~`j5 ti January 21, 1975 trailer will be owner-occupied by a member of a family estate, which could very well wind up in lengthy litigation for the settlement of an estate.' Councilman House withdrew his motion, and Councilman Graham moved that the matter be tabled until the next meeting of Council. The motion was seconded by Councilman Clark. Neblett - aye Jesse Hopkins and Paul Roop appeared bef ore Council relative to the drainage situation on the south side of Monte Vista Drive and Bob I] White Boulevard, and which drainage situation will be involved in the construction of the Second Fhase of Memorial Drive. Mr. Roop reported TOWN MGR . TO CONTACT having met with Mr. Angle of the State Highway Department in Roanoke HIGHWAY DEPT. Councilman Graham moved that PHASE II the Street Committee work with Town Manager Marshall on this. Mr. Graham withdrew this motion and moved that the Town Manager be authorised to contact the State Highway Department and do whatever is necessary to bring this to Council for a final conclusion. The motion was seconded by Councilman Clark, and carried. Morris Burton advised Council that he had appeared bef ore Council on December 3, 1974 requesting certain funds for the operation of the FUNDS FOR NEW RIV. of the New River Rescue Squad, and the matter had been referred to the RESCUE SQ. NOT CO~T~I- Finance Committee but they had heard nothing further relative to the DER ED YET matter. Finance Chairman House stated the Committee had met but inadvertently failed to discuss the request, but that the Committee 5'726 January 21, 1975 would be meeting soon and the matter would be discussed at that time. Mr. Burton also advised Council that in approximately 1968 an agreement was made between the then To an Manager and Police Chief C. E. Comer for the New River Valley Rescue Squad to operate on Radio Frequency 39.5, and they had now been advised by Pulaski County Administrator, Mr. Nichols, that they PUBLIC SAFETY were illegally operating on that frequency, and should be using COMM. TO STUDY RADIO FREQUENCY 45.52, which frequency, Mr. Burton stated, is not great enough 39.5 or 45,32 FOR NEW RIVER f or the many needs of ,the Squad in transporting wreck victims RESCUE SQUAD and critically ill persons to hospitals within the State. Council- man Graham moved that the matter be turned over to the Public Safety Committee for a recommendation to the Council. The motion was seconded by Councilman Brockmeyer, and carried. Councilman Hickam reported that the Street Committee had met and examined the 1969 Thoroughfare Plan presented by the State Highway Department, and it was the feeling of the Committee that THOROUGHFARE PLAN SHOULD BE because of the change in traffic patterns and the fact this Plan UPDATED & RESOLUTION was presented bef ore Interstate 8L was considered, it was the ELIMINATING PORTIONS OF recommendation of the Committee that the Highway Department 1969 THOROUGHFARE PLAN be requested to up-date the Plan for Council's further considera- tion; that as requested by Council at its meeting of November 19, 1974, a proper resolution be brought to Council for adoption involving the proposed road change of North Washington Avenue and Route 11 through Northwood down Washington Avenue and the removal of the median strip from Fifth Street to Prospect Avenue,. contained in the Highway Department's 1969 Thoroughfare Plan. Mr. Hickam further stated that the Planning Commission had recommended the removal of this road change from the Plan as far as the County is concerned. Councilman Graham reported a meeting had been called of the Utilities Committee for the 23rd to discuss a Regional Water REGIONAL Quality Plan proposed by the New River Valley District Commission, WATER QUALITY PLAN TO BE and it was hoped by the next meeting of Council a report could be DISCUSSED` made on this as well as a matter involving the Filter Plant. J~~ January 21, 1975 Councilman Brockmeyer stated he had no report, but commented upon the fact that street signs had been erected on Maple Street. Mr. Brockmeyer also suggested that some thought be given to the traffic situation at the shopping mall on Route 99, and Town Manager Marshall gave a report on the status of this study. Mr. Marshall stated he TRAFFIC would follow up on this. Mr. Brockmeyer asked that it be carried under SITUATION RT. 99 & "pending projects" on Council's agenda. Councilman Graham seconded MALL TO BE CARRIED this motion, which carried. Councilman Brockmeyer also inquired ON COUNCIL AGENDA relative to the status of the request for sidewalks at Northwood and Claremont Schools, and Councilman Hickam stated he had heard about a SCHOOL petition or petitions being circulated, but knew nothing on the positive SIDEWALKS side of this. In answer to Mr. ~rockmeyer's question relative to the VALLEY RD. status of the road across Town property from Valley Road to Route 11, REQUEST Town Manager Marshall advised it is being. studied by the Engineering PULASKI Department. Mr. Brockmeyer was also advised that the situation of THEATRE MARQUE the marque at the Pulaski Thestre was also being looked into. Councilman Vaughan stated he had no report. Councilman House reported the Finance Committee had reviewed FINANCIAL STATEMENT the financial statement of the Town for the current year, and went over STUDIED in detail the monthly report. Town Attorney Moore read the ordinance to Council, and Councilman ORDINANCE Brockmeyer moved the adoption of the ordinance and set February 1, 1975 as the date the ordinance shall become effective. Vaughan - aye James M..Neblett - aye `~'~^•~ January 21, 1975 AN ORDINANCE TO AMEND AND RE-ENACT, AS AMENDED, SECTION 26-6.1 OF CHAPTER 26, TAXICABS AND .OTHER VEHICLES FOR HIRE BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, meeting in regular session on this 21st day of January, 1975, that: Sec. 26-6.1 Same -- Schedule within Town. (c) For the purpose of this section travel along a street which is a zone line, shall be travel through a zone. (4-7-59; 9-6-66; 3-4-69; 3-7-72) Councilman Neblett reported the Public Safety Committee POLICE DEPT. had met and it appeared that all seemed to be going well on the new OPERATING WELL UNDER schedule in the Police Department. Coake, Town Engineer Co-terminus-official tenure Town Attorney Moore presented for Council's consideration an Agreement between the Town and the First United Methodist Church of Pulaski, involving the installation of a radio lead-in AGREEMENT wire between the main church building and its office building AND"ORDINANCE GRANTING located just west of the church building, and an Ordinance FIRST UNITED METHODIST granting a permit to the First. United Methodist Church of Pulaski, for CHURCH AN EASEMENT said installation. The Agreement and Ordinance was read to Council by Town Attorney Moore. Councilman Clark moved the execution of the Agreement by the Mayor and Clerk, and the adoption of the Ordinance, as follows: The motion was seconded by Councilman Brockmeyer, and carried on the following recorded vote: C. Neblett - aye ORDINANCE TO GRANT A PERMIT TD FIRST UNITED METHODIST CHURCH OF PULASKI, VIRGINIA, FOR INSTALLATION OF A RADIO LEAD-IN i:INE ACROSS ORDINANCE AN ALLEY BETWEEN THIRD AND FOURTH STREETS, NORTH, AND WEST OF JEFFERSON AVENUE, IN THE TOWN OF PULASKI, VIRGINIA WHEREAS, the Town of Pulaski has agreed to grant a permit to First United Methodist Church of Pulaski, Virginia, to install a radio lead-in line over and above the alley between Third and Fourth Streets, North, and lying west of Jefferson Avenue, in the Town of Pulaski, Virginia: x'730 January 21, 1975 NOW, THEREFORE, BE IT ORADINFsD by the Council of the Town of Pulaski, Virginia, meeting in regular session on this 21st day of January, 1975, that: The agreement dated the 8th day of January, 1975, between the Town and First United Methodist Church of Pulaski, Virginia, wherein the Town agreed to grant a permit to First United Methodist Church of Pulaski, Virginia, for the installation of a radio lead-in line across an alley above described, as this day presented to Council. Whereupon, of ter due consideration the Council does hereby ratify and approve the of orementioned agreement _. and hereby authorizes and directs the Mayor of the Town of Pulaski to execute said agreement and the Clerk of ORDINANCE said Council to affix her name and the Town seal thereto, on the part of the Town, and other officials of the Town shall do such other things as may be necessary and proper in order to carry out the terms and conditions of this agreement. The Council does hereby direct that a certified copy of this ordinance be delivered to First United Methodist Church of Pulaski, Virginia, which, together with a copy of the agreement entered into by the parties, shall serve as a permit for the installation, use and maintenance of radio lead-in lines, and supporting structures above and across the alley at the location and under the conditions stated in said agreement. Mayor Ratcliff reported that as had been requested by the Council, contacts had been made with Senators Scott and Byrd relative GAS to the gas shortage in this area, and these gentlemen had offered SHORTAGE their support. Town Manager Marshall reported that an answer had been received from the Corps of Engineers regarding the status of the report for a potential small flood project on Peak .Creek at Pulaski, STATUS REPORT OF and as stated in the letter from Colonel Scott B. Smith, District CORPS OF ENGINEERS Engineer, Huntington, West Virginia, the investigations are REPORT ON FLOODING ~' essentially complete and it appears that the Corps of Engineers PEAK CREEK will be unable to participate in a small flood control project at Pulaski. In this regard they were not able to identify any structural measures that would approach economic justification. The findings, in detail, were given in Colonel Smith's letter, snd were discussed with Council, and is a part of the Flood Control Files in the Town Manager's office. January 21, 1975 ~~~1 Town Manager Marshall stated that copies of the by-laws of the New River VAlley Criminal Justice Training Center will be sent BY-LAWS OF NEW RIV. to the Council within the next few days, stating further, that these VA .CRIMINAL JUSTICE must be approved by the participating governing bodies. CENTER MUST BE APPROVED At 9:00 P. M. Councilman House moved that Council go into BY GOV. BODY executive session for a discussion of a legal matter. The motion EXECUTIVE was seconded by Councilman Neblett, and carried. SESSION At 9:55 P. M. Councilman Graham moved that Council return to regular- session. Motion was seconded by Councilman Clark, and REGULAR SESSION carried, and the Council therewith returned to regular session. At 9:56 P. M. Mayor Ratcliff inquired if there was further ADJOURNME~~siness to come bef ore Council. There being none, Councilman Graham moved, seconded by Councilman Meadows, that Council adjourn.
