M. in the Council Chambers in the Municipal Building. There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: William A, House, Andrew L, Graham, Arthur L. Meadows, Blair B. Brookmeyer, C. William Hickam, Bob J. Clark, James M. Neblett, Mason A. Vaughan Members of Planning Commission: Mrs. Charles Settle GEOrge A. Hillsman A. D. Clark Also present: Town Manager: J. E. Marshall Clerk: Gladys R. Dalton Visitors: Members of the press and news media Phil Sadler, Attorney for H. C. Gilmer, Jr. and E. D. King, Jr. E, l). King, Jr. in person William Coltrane Mr. Stoneman, Camelot Nursing Home Representative The invocation was given by Councilman Meadows.. Mayor Ratcliff stated that the purpose of the joint JOINT PUBLIC public hearing was to consider the petition of H. C. Gilmer, Jr. HEARING RE: and E. 0. Kings, Jr. for the rezoning of a certain tract of land REZONING REQ. in the Town of Pulaski, Virginia, lying between Pleasant Hill FOR GILMER & Drive and Lee Highway (U. S. Route 11), in the Windsor Circle area; KING, FOR and since the petition was received a full investigation has been CONSTRUCTION made and it has now been determined that the Town Zoning Ordinance OF CAMELOT allows hospitals in Residential R-1 zones, and, theref ore, is NURSING HOME suitable for the construction of the Nursing Home as requested. Mayor Ratcliff further stated that a letter dated January 28, 1975 had been received from Mr. Philip Sadler, Counsel for the petitioners, withdrawing their request for rezoning of the tract of land lying on the north side of Lee Highway. Mayor Ratcliff also presented a letter from Mr. John R. Powers, Chairman of the Town Planning Commission in which he stated he was of the opinion that it was not necessary to rezone this property as the present Zoning Ordinance allows the issuance of a permit for the construction of a nursing home at this site. 5'33 January 28, 19.75 Mayor Ratcliff further stated that Rown Attorney Garnett S. Moore had rendered an opinion wherein he was of the opinion that it would not be necessary to rezone this area in order to construct a nursing home at this site. Mayor Ratcliff stated this inf ormation had been in their possession earlier, but it was felt that the joing public hearing should be held as advertised to hear any one who wished to speak on the subject. Mr. William Coltrane, the adjacent property owner to the proposed nursing home site, was present and stated he had no objections, but was present because he was interested in the proposal. Mr. Sadler introduced Mr. Stoneman of Camelot Nurshing Home. M r. Sadler stated he had been authorized by H. C. Gilmer, Jr. and E, O. King, Jr. to withdraw their original petition for rezoning of this JOINT tract of land; that it was his understanding that the Nursing Home will PUBLIC be built as planned, and the remaining land would remain in Residential HEARING R-1 zone. Mr. Stoneman stated they have no plans for the construction CONTINUED of anything other than the Nursing Home. The following excerpt from the opinion of Town Attorney Moore was read by Town Manager .Marshall: "Theref ore, it is my opinion that an institution which, as its primary purpose operates a nurshing home, provides convalescent care, is used as a home for the aged, or a sanatorium, does not fall within the definition of a special care facility and is not excluded in Residential District R-l. "The statement of facts made at the Council meeting by Mr. Sadler, Attorney for petitioners indicated that a nurshing care facility was contemplated, and not an institution rendering care primarily for mental or f eeble-minded patients, epileptics, alcoholics or drug addict. Upon these facts, then I am of the further opinion that the nursing facility could be built in the Residential District R-1, where it is proposed. There is no necessity for rezoning." 5`34 January 28, 1975 Councilman Graham moved that the Letter dated January 28, 1975 from Mr. Philip Sadler, Attorney for H. C. Gilmer, Jr. and E. O. King, Jr., the petitioners, asking the withdrawal of the petition for the rezoning of the tract of land Lying on the north side of Lee Highway from R-I to B-l, be accepted; and that it be handled through the normal administrative channels provided in the Zoning Ordinance. The motion was seconded by Councilman House, and carried on the following recorded vote: ,JOINT C. William Hickam - aye William A. House - aye Andrew L. Graham - aye Bob J. Neblett - aye HEARING All letters and the opinion of the Town Attorney were CONTINUED made a part of the file on this subject. At 4:30 P. M. Councilman Brockmeyer moved that the meeting be adjourned.
