There were present: Mayor Raymond F. Ratcliff, presiding. Councilmen: Andrew L. Graham, Blair B. Brockmeyer, C. William Hicka~h, Jr., William A. House, Arthur L. Meadows, James M. Neblett, Bob J. The minutes of the regular meeting of June 17th snd special meeting on June 23rd were approved as recorded. L As had been advertised in the local newspaper, Council held a public hearing on a proposed amendment to Section 25-28 of the Town Code governing setback lines for construction on streets and alleys; said proposal being that building con- PUBLIC HEARING ON ORDINANCE struction shall be prohibited within twenty-five feet of the RE: SETBACK LINES PROPOSAL right of way lines as may exist or hereinafter be established RTS. 11, 99 & 611 - GROSECLOSFon U. S. Route 11, Virginia Route 99, Virginia Route 611, and OPPOSED the sections of Memorial Drive which cross business or industrial zones. Mayor Ratcliff stated Council would be glad to hear any one who wished to speak either for or against said proposal. Alan Groseclose stated that he is part owner of a small lot on Route 611, approximately 20 feet long by 50 feet wide, and slopes doen to no width at all, and if this ordinance is adopted it would confiscate a portion of his lot and prohibit any type of building thereon. Mr. Groseclose said he believed this was the only site which would be so affected, but he wanted Council to be aware that it will affect this property, ~i~_3 July 1, 1975 and such a procedure is not like condemnation proceedings, where a property owner receives compensation for damages to his property. Councilman Neblett moved that the matter be referred to the Town Planning Commission. The motion was seconded by Councilman Brockmeyer, and carried on the following recorded vote: C. Neblett - aye Council held a public hearing on the application of Rachel RACHEL BROWN TRAILER 'PERMIT APPROVED Brown to place a mobile home on Lot 13 on Highland Terrace. No one appeared either for or against this permit, and Town Manager Marshall recommssnded that same be approved. Mr. Turman presented to Council copy of his STUDY REQ. FOR TAXI RATE financial statement and letter requesting the increase in cab fares INCREASE within the four zones of the Town. Councilman Graham moved that the request be referred to the Ordinance Committee. The motion was seconded by Councilman House, and carried on the following recorded vote: C. Mr, Ratcliffe suggested that a wall be installed, and there KERSEY BOT. ASKS FOR was some discussion as to what steps might be taken. Councilman RELIEF OF PEAC.K CREEK Graham moved that the matter be ref erred to the Land and Buildings WASHING LAND AWAY Committee and Town Manager for a report, as well as to the Town's liability, at the next meeting of Council. The motion was seconded by Councilman Meadows, and carried. ~~~ ~ HICKAM GIVES STREETCOMM. REPORT July 1, 1975 Councilman Hickam stated traffic warning signs had been placed on Route 11 in the Hospital Zone. Also, that the matter of Medallian Drive is still pending. Councilman Graham reported the Utilities Committee had develop plans, specifications and cost estimates for expansion of the town's water treatment plant, and it was felt that with the rapid pace of growth in the area that expanded or additional facilities are needed and time is of the essence. The Committee felt the County should negotiate with the Town of Dublin as to what their plans are, which would be a help to the Town of Pulaski in developing its plans. Councilman Graham advised that Council would be advised of all developments in this matter. Councilman Brockmeyer reported on a recent meeting with Mr. Dorer, Director of Bureau of Solid Waste and Vector Control, REPORT ON for the State of Virginia, Town Manager Marshall, E. L. Early MEETING WITH STATE OFFICIAL and H. R. Coake at the landfill on Draper's Mountain. Mr. RE: LANDFILL Brockmeyer stated Town Engineer Coake is in the process of getting a plan ready to submit to the Water Control Board, and hope to secure the approval of the Board. Neblett - aye met with Town Manager Marshall and reviewed the comments pre- pared by Mr, Marshall concerning the application of the Pulaski County Service Authority for the implementation of a county-wide water system, including construction of a water filt3°ation plant, UTILITIES storage facilities and trunk lines. Mr. Graham stated the Town has a COMMITTEE REPORT ON contractural agreement with the Town of Dublin as well as the WATER SITUATION RE: COUNTY, Pulaski County Service Authority, for furnishing water; that the TOWN & DUBLIN Town has commissioned Wiley & Wilson, Consulting Engineers, to EXECUTIVE session at 4:50 P. M. for a fifteen minute discussion of a SESSION personnel matter. The motion was seconded by Councilman 1 July 1, 1975 `~~.5 At 5:05 P. M. Councilman Graham moved that Council return to REGULAR regular session. The motion was seconded by Councilman Clark, and SESSION carried. Mayor Ratcliff declared Council to be back in regular session. Councilman Hickam nominated Councilman William A. House as the Town's representative on the New River Valley Council on Aging, and HOUSE APPOINTED TO REP. TOWN so moved.. Neblett - aye Councilman Hickam stated it was time to appoint a floating member to the New River Valley Planning District Commission, to serve GRAHAM one year, and moved that Councilman Graham be elected to the Commission APPOINTED FLOATING as the Town's third member. Neblett - aye Councilman Clark reported that the Tennis Courts at Central TENNIS will be resurfaced about the middle of july, at a price some less than COURTS REPAIRED the last quotation. Councilman Clark also reported that the golf driving range at Loving Field will be open in about two weeks. Mr. Clark stated GOLF RANGE AT LOVING the range will be open from LO A. M. to 9 P. M. and that the Town has FLD. SOON TO OPEN acquired a ba1L retriever. Councilman Meadows stated the Ordinance Committee had met in a very busy session during the past week. He stated the Blue & White Cab Company trailer application was discussed and although the Committee was not unanimous in their thinking on this, it was his ORDINANCE COMMTTTEE recommendation that the application be returned to Mr. Turman with REPORT - BLUE & WHITE the advice that he apply for a building permit. Mr. Meadows suggested CAB 'T'OLD TO SECURE that perhaps other members of the Committee might wish to present BLDG. PERMIT their opinions on this. There was some discussion of the matter by Council. Town Manager Marshall stated the Committee felt his fee should be returned and he can apply for a building permit, which will ~~~.s July 1, 1975 be denied, and he can then appeal to the Board of Adjustments and Appeals. Councilman Meadows moved that the application of Blue & White Cab Company be returned to them because the mobile home ordinance is not applicable to this situation. The motion was seconded by Councilman Hickam, and carried. Councilman Meadows reported the t~rdinance Committee felt the Resolution establishing a criteria for any insurance company to be eligible for payroll deductions, be handled as an NO PAYROLL administrative matter. Councilman House moved that there be DEDUCTIONS FCR OUTSIDE BUSINES no payroll deductions for outside business firms. At the request of Councilman Meadows, Town Attorney Moore read an 'Ordinance to amend and re-enact the Town's Building ORDINANCM Code Ordinance, to comply with the State B.D.C.A. Code, and ADOPTING CHANGE IN after a discussion by the Council regarding the amendment BUILDING CODE TO COMPLY WITH to the ordinance, Councilman Meadows moved the adoption of STATE BOLA CODE same. Neblett An ordinance to Amend and Re-enact the Building,Code Ordinance, to Regulate the erection, construction, enlargement, alteration, repair, moving, removing, conversion, demolition, occupancy, and maintenance of buildings or structures in the Town of Pulaski by Adopting by reference certain uniform codes as sections of this Ordinance, and to cite them as the Basic Building Code, Basic Meeh~ni;cal Code, Plumbing Code, the National Electric Code, Electrical Code for One and Two-family. Dwellings, Housing Code, One and Two Family Dwelling 1 continued on page 5817 July 1, 1975 Code, Fire Prevention Code, together with their supplements and amendments; to provide for issuance of permits, establish schudles of fees and the collection thereof; and to repeal certain ordinances, and to provide violations and penalties. BE IT ORDAINED by the Council of the Town of Pulaski, Virginia, meeting in Regular Session on this 1st day of July, 1975, that: Sec. 1. Applicability of Ordinance. (a) New buildings and structures erected after July 1, 1975, in the town, and buildings and structures moved into or within the town shall conform to the requirements of this ordi- nance. (b) Additions, alterations, repairs and changes of use or occupancy in all buildings and structures shall comply with the provisions for new buildings and structures, except as otherwise provided in this ordinance. Sec. 2. Title. This ordinance shall be known as the Basic Building Code of the Town of Pulaski and may be cited as such; and the BUILDING Unif orm Statewide Building and other codes, together with their accumulated supplemtnts and amendments which are adopted CODE hereby by reference and set out as sections, shall be referred to individually as the Basic Building Code; the One-and Two- Family Building Code, Mechanical Code, Plumbing Code, National Electric Code, and the Electrical Code for One and Two-Family Dwellings, Housing Code, One and Two-Family Dwelling Code, and ORDINANCE Fire Prevention Code. Sec. 3. Purpose. The purpose of this Code is to provide minimum standards to safeguard life or limb, health, property and public welfare by regulating and contx olling the design, construction, quality or materials, use and occupancy, location and maintenance of all buildings and structures within the town and certain equipment specifically regulated herein. The provisions d: this Ordinance shall be construed in accordance with the laws of the State and shall supplement any State laws insofar as there is no prohibition upon the Town of Pulaski to exceed the standards of State laws. Sec. 4. Building Officials and Code Administrators (BOAC)- Adopted. There is hereby adopted by the Town Council for the purpose of .establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, including permits and penalties, that certain building code known as the Building Officials and Code Administrators Basic Building Code of 1970 and accumulative supplement 1972, which code is commonly designated BOLA. The same is hereby adopted and in- corporated asp:fully as if set out at length herein and the pro- visions thereof so adopted shall be controlling in the construction of all buildings and other structures within the Town. Sec. 5. Plumbing: Installation of gas equipment and services. (5.1) All plumbing and draining systems shall be installed in conf ormity with the BOCA Basic Plumbing Code of 1970, accumula- tive supplement 1972, and any revisions or amendments thereto, which codes are incorporated herein, adopted and made a part of this ordinance as if they were set out herein. J~J~"V July 1, 1975 (5.2) Fees for permits required by this section shall be determined as hereinafter set out. Sec. 6. Electrical Installations. ,. (6.1) All electrical wiring, apparatus, or appliances for furnishing light, heat~and power shall be in strict conformity with the National Electrical Code, 1971 Edition, and all revisions, and amendments thereto, and the Electrical Code for One and Two- Family Dwellings, which codes, amendments and revisions thereto are incorporated herein, adopted and made a part of this Building Code. (6.2) Fees for permits required by this section shall be determined as hereinafter set out. Sec 7 Housing Code -- One and Two Family Dwellings. Basic minimum housing standards deemed essential for saf e and healthful living and which provide the basic minimum re- quirements under which residential occupancy shall be governed and controlled within the Town of Pulaski are the requirements set out and contained in the One and Two Family Dwelling Code of 1971, and accumulative supplement of 1973, which Code, together with amendments and revisions thereto are incorporated herein and made BUILDING a part of this Code by reference. Sec. 8. Mechanical Code. CODE The BO6A Basic Mechanical Code, 1975, together with all amendments and revisions thereof, are incorporated herein and made a part of this Code by .reference. ORDINANCE Sec. 9. Fire Prevention Code. The BDCA Basic Fire Prevention Code 1975, together with all amendments and revisions thereof, are incorporated herein and made a part of this Code by reference. Sec. 10. Permit Fees. No permit as required by this ordinance or the Building Officials and Code Administrators (BOLA) Basic Building Code of 1960 and accumulative supplement of 1972, shall be issued until the fee prescribed by this section shall have been paid; nor shall an amendment to such a permit be approved until the additional fee, if any, due to an increase in the estimated cost of the building or structure shall have been paid. This schedule of fees and any amendment thereto shall be in lieu of the permit fees set out in the Building Officials and Code Administrators (BOCA) Basic Building Code of 1970 and Accumulative Supplement of 1972. For each additional outlet above five, there shall be a fee of twenty cents. ~I Sec. 11. Appeal. Whenever the Building Officials shall reject or refuse to approve the mode or manner of construction proposed to be followed or materials to be used in the erection or alteration of a building or structure, og when it is claimed that the provisions of this code do not apply, or that an equally good or more desirable form of construction can be employed in any specific case, or when it is claimed that the true intent and meaning of this code or any of the regulations thereunder have ~~~0 July 1, 1975 bwen misconstrued or wrongly interpreted, the owner of such building or structure, or his duly authorizedagent, may appeal from the decision of the Building Official~to the Board of Adjustments and Appeals. Notice of appeal shall be in writing and filed within ninety (90) days after the decision is rendered by the Building Official. A fee of $15.00 shall accompany such-notice of appeal . Sec. 12. Repeal. Those two certain ordinances, the first dated April 4, 1967, and the second January 16, 1973, as well as any other BUILDING ordinance or code section or part°thereof which is in conflict with the provisions of this ordinance, are hereby repealed unless ('ODE said ordinance or code specifically excepts the provisions thereof from this ordinance. ORDINANCE Sec. 13, Violation and penalties. Any person, firm, corporation or agent who shall violate a provision of this code, or fail to comply therewith, or-,with any of the requirements thereof, or who shall~:erect, construct, alter, demolish or move any structure, or has erected, constructed, altered, repaired, moved or demolished a building or structure in violation of a detailed statement or drawing submitted and .proved thereunder, shall be guilty of a mindemeanor. Each such person sha1L be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the p.~ovisions of this code is committed, or continued, and upon conviction of any such violation such person shall be punished within the limits and as provided by State Laws. Town Attorney Moore also presented an ordinance to amend and re-enact paragraph (c) of Section 2-14, Article IV, Chapter 2, of the ORDINANCE Town Code. Councilman Meadows moved that the ordinance be adopted. APPOINTING ADMR. OF CODES The motion was seconded by Councilman Neblett, and carried on the & QUALIFICATIONS following recorded vote: C. Neblett - aye AN ORDINANCE TO AMEND AND RE-ENACT AS AMENDED, PARAGRAPH (c) OF SECTION 2-14, ARTICLE IV, CHAPTER 2, OF THE CODE OF THE TOWN OF PULASKI, VIRGINIA BE IT ORDAINED BY THE Council of the Town of Pulaski, Virginia, meeting in Regular Session on this lst day of July, 1975, that: Paragraph (c) of Section 2-14, Article IV, Chapt~r,..2, entitled "Office of Building and Zoning" be, and the same is hereby amended and re-enacted as follows: ~~ 1 L Continued on page 5821 July 1, 1975 Ordinance continued - Sec. 2-14. Established; qualifications and appointment of administrator; codes and ordinances to be enf orced . (c) The codes to be enf orced through the office of building and zoning shall be the Zoning Ordinance, the Basic Building Code, the One and Two-Family Building Code, the Basic Mechanical Code, Basic Plumbing Code, the National Electric Code, and the Electrical Code for One and Two-Family Dwellings, the Housing-Property Maintenance Code, and all accumulated supplements and subsequent amendments to the of oresaid codes and any and all other related ordinances. This ordinance amending Chapter 2, Article IV shall become effective upon adoption. Councilman Meadows further reported the Ordinance known as FOWL & ANIMAL the fowl and animal ordinance needs more inf ormation and study, as ORDINANCE well as there are other ordinances under consideration by the Committee TO GET MORE which need more study bef ore reporting to Council. STUDY Councilman Neblett had no report, but inquired relative to a photo of the former Mayor Edens for the Council Chambers, and the status of the traffic light at the Route 99 Mall. Councilman Vaughan reported that several weeks ago the Town Manager was instructed to secure bids on the grazing land at Loving Field, and the highest bid was that of Robert Whitman in the R.WHITMAN amount of $1,525.00. He stated it was the recommendation that an BEST BID ON GRASING LAND agreement with Mr. Whitman on this basis be drawn by the Town AT LOVING FIELD-AGREE- Attorney, and so moved. Town Manager Marshall advised Council of the administra- tive error made in the request of Ron Lindamood of Pulaski Flower Shop for a certain area back of the Shop to be rezoned B-2, in that a requirement that all adjacent property owners as well as those NEW HEARING TO BE HELD IN across the street, be advised by certified mail of the public PULASKI FLOWER SHOP PETITION hearing, Mr. Moog suggested that Council reconsider the action FOR REZONING taken by them on June 17, 1975 when an ordinance was adopted rezoning this area to classification B-2.
