HomeMy WebLinkAbout06-21-71~~t~~~ Minutes of a Special Meeting of the Pulaski Town Council, held June 21, 1971, at 7:30 P. M. in the Municipal Building. Mayor Edens stated that this was a Special Meeting called as a result of not having a quorum for the regular meeting scheduled for June 15, 1971. There were present: Mayor C. Robert Edens, presiding. Councilmen: S. G. Frye, A. L. Graham, J. H. White, Glen K, Aust, R. F. Ratcliff and Jack Congrove Mr. Ratcliff arrived for the meeting at 8:30 P . M. Also present: Town Manager: J. E. Marshall Town Attorney: Garnett S. Moore Visitors: J. R. Schrader, Southwest Times reporter Joyce Gardner, Reporter for WPUV Dennis and Bobby Jackson, Mike Tilley, Homer Hawkins, J. B. Warner, Mrs. 0. M. Duncan, Bob Bunts and W. F. Thomas, Jr. The invocation was given by Councilman White. Mayor Edens called the meeting to order at 7:30 P. M. Council appointed Doris F. Graham, Acting Clerk of Council. The minutes of the meeting of June 1, 1971, were apprc~ed as recorded. Mayor Edens stated that this was the time for a public hearing on the proposed budget and asked if thew were any questions on the proposed 1971-72 Budget. J. B. Warner stated that some question had come up as to how PUBLIC the new municipal building would be paid for. He wanted to know if the HEARING ON Town Baas in debt. Town Manager Marshall answered in saying that PROPOSED fortunately, so far, we had not had to go to banks for credit. All 1971-72 payments have been made from the general fund. There will probably have BUDGET to be a loan from the water fund to the general which would be paid back at an interest rate which the Council would set. Bob Bunts asked how much the furniture would cost for the new building.' Mr. Marshall answered -$14,000.00. The Town .has been able to BUDGET meet all of the obligations on the Municipal Building with no tax ADOPTED increase. There being no other question or comments, Mr. Frye .moved that the 1971-72 budget as proposed by the Town Manager and amended by Council, be adopted. with appropriations made thereto with the exception that Capital Expenditures be made only after consultation with the Finance Committee. The amount required is provided in various functions such as Lease of Equipment, Repairs, Gas .and Oil, etc. ~~ ~a~~~ June 21, 1971 Application to place a mobile home belonging to David Lovern on Crescent Street was scheduled for public hearing and there D.LOVERN TRAILER being no one to speak for or against it,,it was recommended by APPLIC. APPROVED To~zn Manager Marshall to be approved, being an individual.-.lot with water and sewer available. Mrr Graham moved that_the recommenda- tion be approved. The motion was seconded by Councilman White, and carried. A trailer application in the name~of Homer Hawkins to place a mobile home on East Fourth Street was presented to Council H.HAWKINS by`Town Manager Marshall and the scheduled public hearing was held. TRAILER APPLIC. The Town Manager stated there was not enough room to accomodate two CARRIED OVER TO trailers. He was called by a person in opposition therefore, and NEXT MEETING recommended it not be approved. After some discussion, Mayor Edens suggested. that more consideration be made of the application in view of the area being in the M-1 zone. Councilman Graham moved that the Council. carry this matter to the next meeting to allow more considera- tion and study. The motion was seconded by Councilman Aust, and carried. W. F. Thomas, Jr. Attorney for Fred Jackson, et als, spoke on behalf of the rezoning in the Mathews Court area. R02, Districts, in the Town of Pulaski, Virginia. Mrs. 0. M. Duncan again mentioned air pollution in Pulaski. AIR POLLUTION Mayor Edens stated that since the State provided. this service at no cost & MRS. DUNCAN to the Town, the matter had not. been looked into further. The cost would be too much when it could be gotten free from the state. J. B. Warner presented a pollution problem in the Oakhurst area. 1 Mr. Marshall stated they had not had an opportunity to do anything about WARNER it but planned to in the future. Warner also requested that a sign "CHILDREN AT PLAY" "Children at Play" be erected in the neighborhood. These matters will SIGN OAKHURST be looked into by the Town Manager. AVE. Mayor Edens read a resolution from the Jaycees on air pollution, which is as follows: 1 The Pulaski Jaycees go on record, advising the Town of Pulaski, not to enact legislation, separate from existing and proposed State & Federal statute, concerning water and air pollution for the following reasons: AIR POLLUTION 1. The town is ill prepared to administer the ordinance, using qualified and trained personnel and machines, RE: JAYCEES when the State and Federal Government already provide REQ. TOWN NOT strict monitoring and testing through existing agencies. TO ENACT LEGISLATION 2. The town can ill afford the stigma of having an ordinance stricter than State and Federal statutes. Our town needs new industry, to provide jobs lost through reduction of the Radford A~`senal, and other local industry. New industry will seek :the best municipal climate in which to operate and will bypass Pulaski. 3. Existing and proposed Federal and State. statutes, prohibit all pollution, arrd provi'd.e a strict,. supervised climate in which industry must operate. The Federal & State governments haver the trained engineers, resources and budgets to provide -for 100% compaiance with the law. The Town of Pulaski is not monetarily endowed to compete with these agencies. j~ ~s June 21, 1971 4. Town ordinances are subject to pressure from a minority ' of the population, who. may be untrained in industrial problems and their solutions. State and Federal statutes provide for the equal application of the law to all Indus ry with no favoritism possible either toward or against industry. Town Attorney Moore presented a petition.. requesting that SCOTT the Town Council. take the necessary action to close a 10 feet wide NOTICE & PETITDN walkway running through the lands of Reginald D. Scott and Myrtle PRESENTED FOR G. Scott located between lots 67 and 68, Section C as shown on a CLOSING 10 FT. WALKWAY OR revised map of Macgill Sub division on record. in the Clerk's ALLEY Office in Plat Book 1, Page 62 in the Town of Pulaski, Vir ginia, Mr. and Mrs. Scott in .their application stated that they were the owners~of the property on both sides of the walkway. Notice of Application and Petition, are as follows: NO TIC E'.OF'APPLICATION TO THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, FOR THE CLOSING OF A TEN FOOT WIDE WALKWAY RUNNING THROUGH LANDS OF REGINALD D. The petitioners own the land on both sides of the said walkway proposed to be closed. SCOTT TO THE MAYOR AND MEMBERS OF THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA: The undersigned respectfully petition the Council of the Town of Pulaski, Virginia, to close that certain ten foot wide walkway located between Lots 67 and 68 in Section C as shown on a revised map of Macgill Subdivision of record in the Clerk's Office of the Circuit Court of Pulaski County, Virginia, in Plat Book 1, page 62, in the northeast section of the Town of Pulaski, Virginia. June 21, 1971 That:-all:necessar.y steps and procedure,-including any notices, appointments of viewers, etc., be conducted in this matter and upon completion of all the required steps, that the Council by ordinance grant the abandonment and closing of said walkway and release any and all claims thereto to the adjacent property owner as provided by law. Scott and Myrtle G. Scott, of Pulaski, which are described as follows: IN CLOSING 10 FOOT WALKWAY OR ALLEY PROPOSED TO BE CLOSED WALKWAY OR ALLEY ~~. ~~ ~'~~ June 21, 1971 That certain 10 foot wide walkway or alley begin- nirig in the Southernboundary of Lynwood Street between Ldts X67 'and fs8` in Section C, as' shown on a revised map of Macgill Subdivision of record in the Clerk''s Office of the 'Circ~3i~t Cottrt of Pulaski County, Virginia, in Plat Book 1, Page 62; thence running between"parallel lines of Lots 67 and 68 the length of the aforesaid lots a distance of 150'feet to the Northern Boundary line of a service driveway near a parcel on the aforesaid plat as being "reserved for business". (`5) What -the said Town Manager and Attorney for said Town do any and all other things necessary for the proper determination of this matter. 1 1 ~. ~3 June 21, 1971 Town Manager reported to Council on the 1970 tax levy and collection. He stated that the total taxes and penalty for 1970 was $208,490.12 and that the collection through June 10, 1971, 1970 TAX LEVY was $197,0.75.b4, or 94.537.. He stated that for this time of the & COLLECTION tax year this is considered good. Town Manager also reported that he thought an additional $75,000. $75,000.00'_1 had been approved by the Highway Department for the ADDL AYPROP. FOR Allison Lane project, however, he would confirm the total amount. ALLIS©A1 LN PROJEC'~ The Council was informed that the Electrical Franchise had been accepted by Appalachian Power Company. Councilman Ratcliff APCO.EI.EC. moved, seconded by Councilman Congrove, that the franchise be accepted FRANCHISE ACCEPTED back by the Town and placed in the proper book. Motion was carried.
