Jackson, presiding. Councilmen: T. J. McCarthy, H. H. Eggert, C. B. Gallimore, S. G. Frye, Raymond F. Ratcliff Absent: W. S. Cummings, Glen K. Aust, Rudolph Farmer Also present: Town Manager: Evan Norton Clerk: Gladys R. Dalton The invocation was given by Councilman Ratcliff. Mayor Jackson stated the special v~seting was called for the purpose of considering and taking necessary action on an ACTION NEC. ON agreement with the Highway Department concerning the construction HIGHWAY AGREE- MENTRT. 99, & and maintenance of Route 99 and Route 11-Pico Terrace Projects, PICO TER. & RT. 11 for Highway Improvements, according to the Waiver of Notice of Special "eeting of Council, as follows: WAIVER OF NOTICE OF SPECIAL MEETING. 1 We, the undersigned, duly elected members of the Council of the Town of Pulaski, Virginia, hereby waive notice of a Special Meeting of said Council at 3:15 P. M., on the 8th day of April, 1968, in the Council Chambers, for the purpose of considering and taking necessary action on an agreement wi th the Highway Department concerning the construction and maintenance of Route 99 and Route 11-Pico Terrace Projects, for Highway i:xprovements. WITNESS our signatures this 8th day of April, 1968. ~ ~s(:~2 Council mins. contd. t~/8/68 Town Manager Norton advised that the Town had been advised by the Highway Department that Unaka Paving Company, Incorporated, was the successful bidder on the Route 99 and Route 11 projects, and that before the work can be awarded them the Highway Department and the Town of Pulaski must enter into an agreement concerning the construction and maintenance of these two projects. He further stated it was necessary for Council to adopt a resolution designating some one to execute the agreement with the Highway Department, and upon the motion of Councilman Gallimore, seconded by Councilman Eggert, and carried on the following vote: Raymond F. Gallimore -aye the following resolution was adopted approving the agreements and designating the Town Manager to sign same on behalf of the Town of Pulaski: WHEREAS, the Council of the Town of Pulaski, RTt 99 & Pico Virginia, has pending before it an agreement between' TER.-RT.11 - the Department of Highways, Commonwealth of Virginia, RESOLUTION and the Town of Pulaski, Virgi nia, for a project for ADOPTING AGREEMENT the improvement of 0.5t~9 mile of Route 99 within Pulaski WITH HIGHWAY DEPT. from 0.5t~9 mile south of North Corporate Limits Pulaski to the North Corporate Limits of Pulaski, Station !~~ + 00 to Station 73 + 01.58, known as Randolph Avenue, and designated as Route 99, Project 0099-125-102, PE-101, RW-201, C-501, Federal Project US-125-2(!~); and, WHEREAS, the Council has reviewed the conditions of said agreement and desires to request the Highway Department to submit the project with recommendation that it be approved by the Bureau of Public Roads, and if approved and constructed, to maintain it at its own cost and expense, and that they will make ample provision each year for such maintenance; and, WHEREAS, the Town agrees that the location, form and character of informational, regulatory, warning signs, curb and pavements or other markings and traffic signals, installed and placed by any public authority, or other agency, shall be subject to the approval of the Highway Department with the concurrence of the Bureau of Public Roads; and, 1 u ., [~ ~~ ~~~ Council mins. contd. 4/8/68 :1 1 WHEREAS, the Town agrees to the parking restrictions, to the placing of proper signs, and that such will be as to the size, design and color in keeping with uniform traffic control devices; and further, that Pulaski will not use prison labor in any manner on the project; and further that Pulaski agrees to the participation in the actual cost of the project. NOW, THEREFORE, BF IT RESOLVED BY THE COUNCIL OF THE TOWN OF PULASKI, VIRGINIA, meeting in special Session on this 8th day of April, 1968, that: (1) The aforementioned contract be, and the same is hereby, ratified and approved, and that the provisions and conditions therein contained be carried out by the proper officials of the said Town. RE50LUTION (2) The estimated cost of. the share for the Town CONTINUED of Pulaski be hereby ratified and confirmed and the Town by these presents agrees to pay, upon rendering of a proper CQPY OF bill by the Highway Department, the said sums due as the Town's share on said project. AGREEMENT (3) A copy of the agreement be attached to this FOLLOWS Resolution and incorporated in the minutes of this meeting. Pulaski, Station 44+OU to Station 73+01.58, known as Randolph Avenue, and ~?r~signated as Route 99, Project 0099-125-102, PE-101, RW-201, C-501, Federaa t'roject US-125-2(4}, 2, Pulaski hereby requests the Highway Department to submit the aforementioned project with rer~ommendation that it be approved by the Bureau of Public Roads and agrees that if such project is approved and constructed by the Highway Deportment and the Bureau of Public Roads, it, thereafter, at its own cost and expense, will maintain the project, or have it maintained, in a manner satisfactory to them or their autho- rized representatives and will make ample provision each year for such maintenance. 3. Pulaski hereb=~ agrees that the location, form and character of informational, regulr-~t:ory, warning signs, curb and pavement or other markings and traffic signals, installed or placed by any public autho- rity, or other agency shall ue subject to the approval of the Highway Department with the concurrencr~= of the Bureau of Public Roads. 4. Parking, if permitt~:d, shall be parallel and adjacent to the curb. No double or angular ~>arking shall be allowed at any time. 5. At places where parking is prohibited, the appropriate NO PARKING sigr-s shall be erected. The size, design and color of such signs shall conform to the standards as shown in the latest edition of the Manual on Uniform Traffic Control Devices. 6. Pulaski agrees that prison labor will not be used for any purpose whatsoever on this project during the time it is under con- struction agreement between the Highway Department and the Bureau of Public Roads. 7. Pulaski agrees to participate in the actual cost of this project in accordance with the following tabulation, understanding that the costs shown are estimated and the percentages will be applied to actual costs. APPROVED AS TO FORM own Attorney V ~ r. ~~.~~ ~~ .z AGREEMENT BY MUNICIPALITY OR POLITICAL SUBDIVISION TO MAINTAIN HIGiiWAYS IMPROVED UNDER THE CODE OF VIRGINIA AND THE POLICIES OF THE HIGHWAY COMMISSION ' The Town of Pulaski, State of Virginia, hereinafter re- ferred to ae Pulaski, and the Virginia Department of Highways, hereinafter referred to as ttie highway Department, hereby agree as follows: 1. That the Highway Department will prosecute a project for the improvement of 0.08 mile of Route 11 within Pulaski from 0.019 mile north of Edgehill Drive to 0.099 mile north of Edgehill Drive, Station 14+50 to Station 18+75, designated as Route 11, Project 0011-125-101, PE-101, RW-201, C-501. 2. Pulaski hereby requests the Highway Department to pro- secute the aforementioned project with recommendation that it be approved and agrees that if such project is approved and con- structed by the highway Department, it, thereafter, at its own cost and expense, will maintain the project, or have it maintained, in a manner satisfactory to the Highway Department or its authorized representatives and will make ample provision each year for such maintenance. 3. Pulaski hereby agrees that the location, form and char- acter of informational, regulatory, warning signs, curb and pave- ment or other markings and traffic signals installed or placed by any public aut}~ority, or other agency, shall be subject to the approval of the [iiq}iway Department. 4. Parking will be prohibited at all times on both sides of this project as above described. 5. At places where parking is prohibited, the appropriate NO PARKING signs shall be erected. The size, design and color of such signs shall conform to the standards as shown in the latest edition of tl~e Manual on Uniform Traffic Control Devices. 6. Pulaski agrees that after construction of the project, or any part thereof, it will not permit any reduction in the number or width of traffic lanes, additional median crossovers, enlargement of existing median crossovers, or alterations of channelization islands, without the prior approval of the Highway Department. 7.
