V. Jackson, presiding. Councilmen: W. S. Cummings, F. L. Carrico, J. W. Nash, Claude B. Gallimore, Eugene Nuckols, Glen K. Aust Absent: T. J. McCarthy, Billy B. Flint Also present: Town Manager: T. B. Noland Clerk: Gladys R. Dalton Town Engineer: R. Lloyd Mathews Visitors: Bill Akers, reporter for Southwest Times E. F. Walcott and L. E. Hurst of the U. S. Forest Service Mayor Jackson welcomed Mr. Walcott and Mr. Hurst of the U. S. Forest Service, the purpose of which special meeting was to discuss with these representatives the recreational potential of the Gatewood Reservoir area, and in particular "memorandum of Understanding between The Forest Service, United States Department of Agriculture, and the Town of Pulaski". After a full and lengthy discussion of the contents of the "Memorandum of Understanding", on motion of Councilman U.S.FORF?ST Gallimore, seconded by Councilman Nash, and carried unanimously, SERVICE .AND TOWN EN'.['ER the Mayor of the Town of Pulaski was authorized to execute INTO AGI~:EEMENT RE: GATE'WOOD on behalf of the Town of Pulaski, the following "Memorandum RESERVOIR AREA of Understandingu: This MEMORANDUM OF UNDERSTANDING, made and entered into this 6th day of February , 1961, by and between the Town o~aski, Sta a o~Pirginia (hereinafter referred to as the "Town"), represented by its mayor, and the FOREST SERVICE, UNITED STATES DEPARTMENT OF AGRICULTURE (herinafter referred to as the "Forest Service"), represented by the Forest Supervisors, Jefferson National Forest, under authority of the Act of May 15, 1962 (5 USC 511) WITNESSETH THAT: WHEREAS, the Town has constructed, operates, and main- .' tains as an integral part of its municipal water system a dam ~' and reservoir in the Peak Creek Watershed, and i WHEREAS, certain lands of the Jefferson National ores lying wholly or partly within the reservoir have been authorized for use by the Town in Special Use Permit dated February 1, 1960, and WHEREAS, other lands of the Jefferson National Forest make up about seventy-five (75) percent of the area in the Peak Creek watershed, and 3~1 Council rains. contd. WHEREAS, the Town has acquired certain lands for pro- ject purposes adjacent to the reservoir and the national forest land, and WHEREAS it is the intent and desire of the Town and Forest Service'to cooperate with each other in the adminis- tration and management of these lands for full public benefit and welfare. NCW, THEREFORE, it is agreed as follows A. The Forest Service: 1. Will manage the national forest resources, accord- ing to multiple use principles, programs and policies, and all operations such as timber sales, wildlife management, recreation developments, road construction, etc. will be designed so as to maintain and improve the soil, water, and other resources of the watershed. 2. Will provide forest fire protection for the Peak Creek watershed area consistent with available funds and manpower. 3. Wi11, through Forest Service Special Use procedure, provide the Town with such areas of national forest land as the Forest Service deems necessary for carry- ing out Town projects. 1~. Will, when so requested, provide the Town with advice and assistance in its development program to make this multiple - purpose project. B. The Town: 1. Will assist in the installation on national forest land of special watershed measures in such amount and kind as are mutually agreed to be desirable to improve the water resource. This assistance can be in the form of equipment use, .manpower, materials or cash contribution. 2. Will construct and maintain to reasonable standards all roads in the watershed for which it is directly responsible. 3. Will, to the best of its ability, carry out the recommendations contained in the report of the FiQh':. and Wildlife Service, dated February 12, 1960, in order to improve and enhance the fishery resource. C. the Forest Service and Town: 1. Will do everything within their means to demonstrate to the public and to other towns and cities good multiple wse of a watershed being managed primarily for municipal water supply purposes. 2. Will cooperate with each other in every way practicable to insure the protection of the area in accordance with a Cooperative Fire Detection, Prevention and Suppression Agreement to be developed. 1 1 1 Council rains. contd. Will develop, manage, and improve, subject to the availability of funds, manpower, and equipment, the resources on their respective lands based on sound multiple use management principles. This includes development and maintenance of suitable recreation facilities to accommodate public camping, picnicing, swimming, fishing, and hiking on land adjacent to the reservoir provided these uses will not be setrimental to the Town's water supply. !~. Agree that no item in this agreement shall be con- strued as an obligation of funds. 5. Concur that a joint meeting will be held on an annual basis to review the contents of this agreement and of other plans developed for the Peak Creek watershed. 6. Concur that this Memorandum of Understanding shall re- main in effect unless cancelled by mutual consent of both parties. IN WITNESS WHEREOF, the parties hereto have executed this MEMORANDUM OF UNDERSTANDING, this 6th day of February _~ 1961.
