Minutes of the regular meeting of the Town Council of the Town of Pulaski, held on the 17th day of March, 1959, at 2 p. m.! in the municipal office. There were present: Mayor C. ©, Jackson, presiding. Councilmen: W. F. White, W. A. Larson, Glen K. Aust, F. L. Carrico, T. J. McCarthy, - John W. Nash and J. R. Martin, arrived daring the meeting. W. Sadler, Attorney for ta~dcab owners, and several owners being present The meeting was called to order by Mayor Jackson, and the invocation was given by Rev. S. Brown Hoyt, pastor of Anderson Memorial Presbyterian Church. Mi~outes of the regular meet3tlg of March 3rd, were approved. Mr. Philip Sadler, an Attorney representing 32 of the presently operating 35 taxis, stated that he wished tka ask Council to consider making several changes in the Taxicab Ordinance of the Town Code. His first request was that items (1), (2), (3), (}~) and '; REQUESTS FOR (5) under (a) of Code Section 18-6 concerning transportation TAXICAB ORD. CHANGES AS charges, be increased by ten cents (lO¢) each, to help take care of !' PRESENTED BY ATTY.SADLER increased living costs, as well as increased operating costs. His second request was that Council established a rate for within corporate limit pickups to outside corporate limits destinations, and pickups outside corporate limits to within. Mr. S adler's third request being that the word "may" appearing in the third line '. of subsection (h) of Section 18-6, page 175 of the Town Code, be changed to "shall". There followed a lengthy discussion in which it was brought out that due to the two recent a~mexed areas, it seemed tc> be the opinion that there should be established a third zone for cab operations in the tows.: Council took no action un these requests, but suggested that Mr. Sadler, Town Manager Noland and Town Attorney Moore meet and try to work out these matters. ~03~ Mr. Sadler stated he felt the presently operating taxi oxners should organize and petition Council to reduce the giber of cabs from thirty-five to thirty - the number thirty-five to be reduced as vacancies appeared. STUDY TO BE MADE Avemae,-was presented~by Town Manager Noland, for the installation of a sealer line. Other necessary sewer line installations were discussed by Council, and it was the feeling of Council that a .study should be made of ne cessary sewer lines and that their constrtaction should be placed in the order of urgency and use. On motion .of F. L. Carrico, seconded by T. J. McCarthy, and carried on the unat~imcus vote of those present, it was resolved APPROVED APPLICA- TION OF TOWN FOR that the Mayor and Clerk be, and they are hereby oath®rized to sign FED. FUNDS FOR PAVING RUNWAYS for the Town of Pulaski the Prc~ect Application which is to be made NRVA t-c~ the Federal Aviation Agency for the paving of the runways at the Neal R3.ver Valley Airport. In a discussion of the pro3ect calling for the construc- tion of a new armory, it was explained t11at it world be necessary EASEMENT GRANTED to grant an easement to the Power Company so that it could POWER CO. On motion of Mr. White, second- TO BE CARRIED OVER ed bg Mr. Larson, and carried unanim®usly, it was resolved that the Mayor and Clerk be authorized to execute an easement granting the right of Applachian Electric Power Compat~y to construct and maintain a power line to serve the nor armory, the line to be lo- cated in the Est satisfactory location. ' There was another discussion of the merits of developing a we31 on the armory site and an alternate plan for extending the town water line to serire the new facility, and it was decided to carry this matter over until the next meeting so that all members would have the opportunity to consider the new plan. There followed another discussion of a plan by xhich MASTER PLAN VPI students, guided by the Professor of Planning, would work on preparation of a Master Plan for the Town, with the estimated DISCUSSION cost to be appro~dmately $3,OOO.OO per year for about three years. March.l7, 1959, 2 p. m. men e~ressed a desire for the town to have the formal Master Plan, it was generally agreed that in view of other General Fund Capital Outlay obligations which are up-coming the town is in no position to say at this time that such a master plan can be secured at this time. Mr. P. M. Sadler, a member of the Planning Commission, dis- cussed this matter briefly with Council during this discussion. It having been explained to Conned tha t the Power Compa~y would shortly begin construction of a power line to serve the Raines Hollow dam and fature caretakers home, motion was made by Mr. White, seconded by Mr. Larson, and carried on the unanimoas GRANTED POWER CO. It was explained that the ease- meat in question would involve some 2,780 feet of line along town owned land and about a mile of land owned by Jefferson National Forest, and about 2,000 feet of land owned by Mr. R. Cummings -absent AN ORDINANCE TO REPEAL SECTION 20-lt2 AND TO AMCND AND RE-ENACT 20-~.2 AS SECTION 20-~.2A, 20-1t2B, AND 20-lt2C, IN PR09IDING FOR SEWER SERVICE CHARGES, BILLING, USERS, WATER LINE BREAKS. Section 20-l~2, Annual Sewer Assessment, is hereby re- pealed. ADOPTION OF ORDINANCE RE Section 20-1~2A, 20-l~2B, and 20-l~2C are hereby enacted SEWER SERV. CHGR. as follows: AND BILLING Section 20-l~2A, Sewer Service Charges. After the cal- culation of each water charge, whether the charge be on a metered or on a flat rate basis, there shall be calculated. and charged an amount equal to forty per cent (l~0~)of said metered or flat rate water charge. Section 20-1t2B, Billing - User. After determination of the sewer service charge has been made under the formula set out in 20-l~2A, the user of said water shall be assessed with the said sewer service charge. The Town Manager shall set up a method of billing said users at regular invervals and it shall be the duty of the Town Manager to see that all users arebilled in the manner-prescribed. 3(~~ Council mires. contd. Suction 20-1t2C - Where an excessive sewer charge is attributable to a break in a water line due to freezing, and if it appears that the owner or occupant corrected the situation as soon as notice was given, or as soon as knowledge of the break could have been obtained in the exercise of due diligence, and if it further appears that the water leakage did not enter the sewer lines,. the Town Manager may ad3ust the sewer charge to equal the average charge for the three preceding months. - On motion of W. A. Larson, seconded by J. R. Martin, and carried on the unanimous vote of those present, an ordinance to enact Section 20 - 28(a), in making it the property owners responsibility for maintenance of water lines on the house side of the curb cock or meter: PROPERTY OWNERS RESP. FOR Town Code 20 - 28(a) WATER LINES ON It shall be the duty of the owner or occupant of any HOUSE SIDE OF premises which has town-water service to properly maintain METERS and to protect from freezing such service line on the private property side of the curb cock or meter, and failure to do so shall n®t excuse the owner or occupant from payment of all charges for water flowing threrugh the meter. The Town Manager explained that during the past few days definite plans had bean made to install a sewer line, ender the Bond Issue program, to serve approximately fifteen homes in the prospect Heights area. It was noted that in preparing for this constriction it was determined that there was a great need of a water line to replace the 1-1/!~" line now serving a groat number of homes and that because of interconnected lines metering. of some houses would not be possible without installation of a new line. The Manager recommended that in connection with the sewer project the town go ahead and install a 6" water main, along with 2 fire hydrants which would adequately serve the area for domestic water use and $3,500. APPROP. FOR would provide adequate hydrant fire protection to approximately WATER LINE & HYDRANTS 35 homes which now do not have such protection. Upon hearing the TO PROSPECT HGTS. report and cost estimate, on motion of Mr. McCarthy, seconded by Mr. Aust, and carried on thennanimoas vote of those present, there was appropriated from the water fund the sam of $3,500.0 for the purpose of installing a 6" main along f3ateway Drive in Prospect Heights, as xell as installation of smaller lines on side streets as needed. ` The meeting ad~vurned at 3:54 p. m.
