HomeMy WebLinkAbout08-03-59~~~~~~ Council Minutes Aug. 3, 1959, $ a. m. A called meeting of the Pulaski Town Council was held in the Municipal offices August 3, 1959, at 8:00 a. m. There were present: Mayor C. V. Jackson, presiding. Councilmen: W. F. White, W. A. Larson, Glen K. Aust, F. L. Carrico, W. S. Cummings Absent: J. R. Martin, JohnW. Nash, T. J. McCarthy Also present: Town Manager: T. B. Noland Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore After an explanation on the purpose of the meeting by the Town Attorney, who had written Council a letter on Saturday with the request that Council meet at the stated hour, motion was made by Mr. Larson, seconded by Mr. Aust, and carried on the unanimous vote of those present, that the session of Council then beginning be declared an executive session. The Town Attorney reviewed the various court proceedings which had been necessary up to this point in the Town's attempt to secure title to approximately 80 acres of land necessary for the development of the new water supply impoundment in Raines Hollow, the property in litigation beir_g that of Robert Raines. It was explained that a consulting forester from VPI had been REPORT ON LEGAL PROCEEDINGS RE: employed to cruise the standing timber on the Raines tract and 80 ACRES OF RAINES LAND: COUNCIL on the basis of his cruise there are approximately 13,200' of AUTHORIZED ATTY. TU SETTLE AT pitch pine; 3,280' of Virginia pine; 9,200' Red Oak; 6,80' of X20.00 ACRE White Oak; 20,l~80' of miscellaneous species, this being a total of approximately 52,6Lt0 board feet, all species included. Also, there appeared to be approximately 161 cords of pulp wood. Mr. Moore stated that on the basis of the amount of timber on the tract which is evidenced by the timber cruise, very likely the $799.00 which had been offered by the Town is too. low a figure. After a review of possible legal costs which would be incident to the condemnation proceedings yet to be '' carried out, the Town Attorney asked Council if it would set a maximum per acre figure which he could use in attempting to settle this matter:; at any point in the proceedings prior to hearing the evidence in the actual condemnation case. At this point Mr. Moore explained that the Court had appointed commiss- ioners, that the commissioners would meet at 9 a. m. on the day of the meeting and that during the morning of that day would ~1~ Council rains. contd. Aug. 3, 1959 8 a, m. view the tract and that immediately after that review the Court proceedings up to this point had provided that immediately after the view by the commissioners the Town could proceed with clearing that portion of the Raines land in question which will be covered by water in the full impoundment. On motion of W. F. White, seconded by W. A. Larson, and on the following recorded vote: W. F. White - aye W. S. Cummings -aye W. A. Larson - aye John ~. Nash - absent Glen K. Aust -aye J. R. Martin - absent F. L. Carrico - aye T. J. McCarthy -absent it was RESOLVED, that the Town Attorney and Town Manager be, and they hereby are, authorized to expend the sum not to exceed $20.00 per acre in their attempts to secure title to the approximately 80 acres of Raines land at any point in the proceedings deemed by the Town Attorney to be expedient; or if a lump sum figure is involved not to exceed $1,998.50.
