Ivi. There were present: Mayor C. V. Jackson, presiding. Councilmen: tiv'. A. Larson, Glen K. Aust, J. W. Nash, F. L. Carrico, W. S. Cummings, T. J. McCarthy Absent: W. F. White and J. R. Martin Also present: Town Manager: T. B. Noland Clerk: Gladys R. Dalton Town Attorney: Garnett S. Moore Visitors: Bill Akers, reporter for the Southwest Times The invocation was given by Councilman Aust. Minutes of the regular meeting of September 1, 1959, were approved. Mayor C. V. Jackson stated the term of office for C. P. Bailey and Philip M. Sadler, as members of the Pulaski Town Planning R.E-APPOINTI~NT OF BAILEY & Commission, had expired and due to the death of Mr. A. W. Gatewood SADLE R, AND APPOIPJTI~'?a,NT there was a vacancy on the Commission. He further stated that he OF STEVFNS TO TOWN PLANNING wished to reappoint C. P. Bailey and Philip M. Sadler as members COI~SSION to the Pulaski Town Planning Commission, with their term of office to expire February 20, 1963. Mayor Jackson appointed Robert W. Stevens to fill the unexpired term, ending February 20, 1962, of Mr. Gatewood. On motion of W. A. Larson, seconded by T. J. McCarthy, and carried unanimously, it was RESOLVED, that the appointments made by Mayor Jackson of members to the Pulaski Town Planning Commission be, and the same hereby are, confirmed. Town Attorney Garnett Moore presented a petition of the Pulaski Hospital, Incorporated, requesting the Ttn~m to exchange with the Pulaski PETITION OF PULASKI HOSP. Hospital, Incorporated, a small strip of Town property now being a FOR EXCHANGE OF STRIPS OF LAND part of the southern portion of Tenth Street, North, which small strip of land is approximately 2-1/2 feet wide and 53 feet long, for a strip approximately 7 feet wide and 60 feet long along 10th Street adjacent to the front of the Hospital, for the purpose of allova- 3~~ ~. P. m. ing the Pulaski Hospital, Incorporated, to use a certain portion thereof for the erection of curb, steps, walks, etc., and other uses in connection with the construction of a new addition to Pulaski Hospital. After a discussion of this request, on motion of T. J. T~cCarthy, seconded by ~5J. A. Larson, and carried unanimously, the following resolution was adopted: WHEREAS, this day came the Pulaski Hospital, Incorporated, after posting due notice on the 9th day of September, 1959, that being the first day of the September Term of Court, at three places in the Town of Pulaski, as required by law, of its intention to file with the Toim of Pulaski, Virginia, its petition requesting said Town to vacate and alter a small strip of Town property now being a part of the southern portion of Tenth Street, North which small strip of land is approximately two and one-half (2~) feet wide and fifty.-three (53) feet long, the abandonment thereof being for the purpose of allowing the Pulaski Hospital to use a certain portion thereof for the erection of curb, steps, walks, etc., and other uses in connection with the construction of a new addition to Pulaski Hospital; and, WHEREAS, said petition was this day filed and said petitioners were heard ore tenus by said Council; and, WHEREAS, said Council has considered same and desires to appoint viewers as is reauired of them under Title 15-756 of the Code of Virginia, as amended; NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Pulaski, Virginia, as follows: (l) That TfTarvin M. Board, E. 0. King, Jr. and Robert Ld. Stevens be, and they are he reby, named viewers to view the strip of .land which said Hospital requested that the Town vacate. (2) That said viewers report in writing to the Council whether or not in their opinion, any, and if any, what inconvenience would result from discontinuing the same. (3) That the said Council directs that the Town Clerk give due notice of the pending petition of Pulaski Hospital, and of a public hearing which is hereby set upon said petition, in the TOWN OFFICES at !t o'clock P. M., on the 6th day of October, 1959. (I~) That said notice be served upon each property owner adjacent to Tenth Street, North of Randolph Avenue, except that notice to an infant or an insane person may be served on his Guardian or Committee, and notice to a non-resident may be mailed to him at his last place of residence, or served on any agent of his in the Town, oe on his tenants on the premises, and in addition thereto said notice shall be published for two successive weeks in the Southwest Times of Pulaski, Virginia, the last publication to be made at least ten (l0) days before the day fixed for the public hearing. Upon eons~idsration whereof, it appearing to the Court that the defendants, ur so ~aany of then as have heerstafore beau determinsd by this Court in a suit to establish ownership, have this day executed a waiver of the statutory period of thirty days for the filing of exceptions to the report of said Commissionaxs, and have indicated that they affirmatively accept said report, and petition the Court for immediate distribution of the award; that the Town of Pulaski has paid unto Marvin G. Graham, Clerk, the sum of ~tineateen Hundred Alinstysight dollars and fifty Cants {$1998.5(3 as ascertained by the said Commissioners in their report, which payment is evidenced by Voucher Ito. 235fi of the Town of Pulaski, Virginia, payable to the said Marvin G. Graham, Clerk; and that the ~~ Council rains. contd. Sept. 15, 1959, ~t p. m. The Town Attorney stated that the suit of Raines v. Town of Pulaski and M. S. Hudgins, had been settled in favor of the Town, FIPvAL DECREE and that a copy of the Final Decree is being placed in the Town's I1Q SUi~i" OF R~IPdFS US. records. In this particular case Raines had tried to enjoin TO?~°~'T1 0~' PULASKI & Pi. S. HUDGINS the town against construction of the dam because it allegedly '; blocked his roadway and he had also sought damages as a result of the alleged blocking of what he claimed to be his right of way. Since the husband of Mrs. Lottie R. Runion, deceased Treasurer, had died less than two weeks after her death, on the 9th day of September, 1959, the Town Attorney stated that since TC~~TN TO PAY the couple had no living children their estate had no financial OI~TJ ?~TEEK5" SALARY DUE TO problems and for this reason payment of sick leave by the town NRS . RUI~'I ON TR~'ASUR~'R does not appear to be necessary at this time. It was pointed out, however, that the town still owes Mrs. Runion one week's salary , which amount would be paid to her estate. The matter of extending sick leave pay to P~4rs. Runion was tabled. Town Manager Noland reported that progress toward acquisition of right of way for the Route 99 and Channel Change project had begur. a few days before the meetir_g, with i•;r. E. 0. Forty-three differ- ent land owners are involved in the right of way situation. Since the federal government is in the process of increasing the federal gasoline tax in order to get revenue for highway purposes , the Route 99 project can be started as soon as right of way is secured. ~~ The Town Manager reported good preliminary progress on construction of the P.rmory, since a considerable amount of necessary'f PROGRESS steel had already arrived.
