Mayer Jackson advised that Alton Crowell, who represents the Town in the matter of hearings on unsafe builr'.ing~, ~*as ill, but that', Mr. Crowell- had advised that Pfr. Doutha~;'s case se heard at this time by Council. John B. Spiess, Jr., r_ttorney for '~`r. Douthat, stated that his client had arpli.ed for a building permit to repair his building on Commerce Street but that same had been refused. Town Tanager "1oland gave a brief background of the case and read the foll~w- ing report of the Firm of roulton, :Maher, a.nd Blake, Structural Engineers.: ''The poor foundation has caused uneven settlement of this building, the inside partitions have separated from the floor and belling as much as two inches, in places, and the floor joists, being too close to the ground, are decayed. Also, the sills are decayed, the supports under the front porch posts have rotted, the front porch floor is missing in places and is dangerous to walk on, the side porch steps, sills, joists and flcoring are badly decayed, the back porch sags considerably and its rafters and sheathing is rotted as a result of a leaking roof, some of the cornice is decayed and is falling, the floors are considerably out of level and the plumbing fixtures are considerably below standard." 31~~(~ COP~TINUFD HEARING ON T. Blake stated he had made no survey of this building since his report to the Town and the report just read by Mr. Noland presented the true picture of the building at the time of his study. I~1r. Douthat stated that the plumbing had been repaired and had been approved by the Health Department. There followed a general discussion with reference to these repairs. Councilman Larson asked I~~r. Spiers if Mr. Douthat intended to make repairs to the building other than the plumbing, to which Mr. Spiers answered that Mr. Douthat had made application for a permit but that it had been refused. Mr. Noland stated that no formal application had been presented, and Mr. Spiers asked that letters of October 6, 199 and October ?3, 199, from the Town Manager to Ivlr. Douthat, be included in any papers pertaining to this case. At this time Mr. Spiers presented Mr. Guerrant of Roanoke, giving Council a copy of NIr. Guerrant's Architectural qualifications, NO ACTIOPI TAKEN and asked him to advise Council of his recent inspection of this BY COUNCIL building. ?^ihereupon, P~Ir. Guerrant stated that the front part of the building, or the east side, is basically sound; the rear or old wing, inside foundation shows signs of settlement, and is carried to the second floor and roof basically. The floor joists are woad and only show some signs of decay, but didn't find any place in either which he thought dangerous and might cause a person to break a leg, nor did he find floors rotted enough to give-way. It was his opinion that the building would not fall down without con- sinderably more settling. He stated the outside walls were relatively true and strong. He further stated there were things about the building which were dangerous and which they would like to have repaired; the front porch sho;ild be removed and concrete floor poured and repair front entrance; t'ne rear porch would have to be removed in its entirety and new one built; outside guttering would be repaired so it would not leak, and there was one chimney on the .lower portion of the building which would gave to be extended, but that the other chimneys seemed to be sound and show no signs of ~~ ~. He stated he had not made an estimate of the cost of such repairs, but according to hid knowledge of Roanoke standards it would be very costly, but he under-'; stood that the owner wishes to do part of the repair work himself which would cut down on the cost. Martin, and carried unanimously, it was R~;SOLV~~:D, that upon the recommendation of the Town Planning Commission that Section 10 of ~'rticle 13 of the Town Zoning Ordinance be rescinded, notice be- given that Council will COUPICIL TO i?O:.,I, PUBLIC I';FARI"I!'T hold a public hearing at its next regular meeting, February 2nd, 1960,1 OP' REPEALING ~F SEC. 10 ART. 13 for the purpose of rescinding or amending Section .10, of Article Zoning O:rd. 13 of the above ordinance. Town Manager Ploland advised Ccuncil that members of the U.S.FORTSTRY U. S. Town I,anager Noland advised there was a matter to be discussed at the suggestion of Delegate G. January 19, 1960, 1a p, m. of Councilman ?~;cCarthy, seconded by Councilman Aust, and carried unanimously, it was R~.SOLVED, that the matter be placed on the agenda at this meeting. After an explanation of. the legal situation by Attorney Groseclose and after a full discussion of same, on motion of J. R. Partin, seconded by W. Carrico -absent it was RESOLVED, that Council request and authorize Pulaski County's Relegate to the General Assembly of Virginia to take such action as is necessary to accomplish amendment of the Charter of the Town of Pulaski, as contained in an Act. of the General Assembly of Virginia approved Parch 31, 191.8, page 595, et sea., to provide for the incorporation into the said Charter of Section 15-77.61, Article 7, Chapter 5.1 of the Code of Virginia of 1950, as amended.
