HomeMy WebLinkAbout2012-04TOWN OF PULASKI TOWN OF PULASKI RESOLUTION 2012-04 WHEREAS, the Town of Pulaski owns and operates a water utility serving the Town of Pulaski and certain areas within Pulaski County outside of the Town's municipal boundaries; WHEREAS, the Town of Pulaski has an immediate need to make improvements to its existing water treatment plant to continue to provide safe and reliable drinking water to its citizens; WHEREAS, the Town of Pulaski has applied for funding for various drinking water projects in the Town; WHEREAS, the Virginia Department of Health Office of Drinking Water offers loan and grant funding for certain drinking water projects and has funded several drinking water projects in the Town; WHEREAS, the Town Council of the Town of Pulaski have reviewed project planning materials and found that the pre-requirements have been met for submitting a funding application; WHEREAS, the Town of Pulaski anticipates the cost of the project to be approximately $2,338,000; THEREFORE, BE IT RESOLVED, the Town Council of the Town of Pulaski hereby votes to seek funding from the Office of Drinking Water for the following project: Water Treatment Plant Category I Improvements in the amount of $2,732,150; THEREFORE, BE IT RESOLVED, that the Town Manager is hereby authorized to submit a funding application for this project, and the Town Manager is authorized to sign any and all documents to accept such funding contingent upon review and concurrence by the Town Council and Town Attorney. AND COOPERATIVE AGREEMENTS This agreement applies to all DWSRF contracts exceeding $100,000. The undersigned certifies, to the best of their knowledge and belief, that: (1) No Federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the awarding of any Federal contract, the making of any Federal grant, the making of any Federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or modification of any Federal contract, grant, loan, or cooperative agreement. (2) If any funds other than Federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress in connection with this Federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form-LLL, "Disclosure Form to Report Lobbying", in accordance with its instructions. (3) The undersigned shall require that the language of this certification be INCLUDED in the award documents for all sub-awards at all tiers (including sub-contracts, sub-grants, and contracts under grants, loans, and cooperative agreements) and that ail sub-recipients shall certify and disclose accordingly. This certification is a material representation of fact upon which reliance was placed when this Vansaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction imposed by section 1352, title 31 U.S. Code. Any person who fails to file the required certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure.
