Clark- Aye Brooks R. Dawson- Aye James A. Radcliffe- Aye G. Tyler Clontz- Aye Michael P. Reis- Absent Mayor Collins- Aye 2. The Mayor asked for a motion to go into Closed Session to discuss the following items: a. VA Code 2.2-3711 (A) 1 (1 item)- Discussion of a Personnel Matter- Town Manager b. VA Code 2.2-3711 (A) 3 (1 item)- Consideration of the Acquisition/Disposition of Real Property The motion was made by Mr. Clark and seconded by Mr. East. Open Session Gregory C. East- Aye James A. Certification of Closed Session- The Mayor asked for a motion to certify that only the following items were discussed in Closed Session: a. VA Code 2.2-3711 (A) 1 (1 item)- Discussion of a Personnel Matter- Town Manager b. VA Code 2.2-3711 (A) 3 (1 item)- Consideration of the Acquisition/ Disposition of Real Property The motion was made by Mr. Clark and seconded by Mr. Dawson. Gregory C. East- Aye James A. Reis- Abstained The Mayor reported Mr. Reis is out of town and asked council if there is any objection to him participating in the meeting virtually. No objections were made. 4. Guests and Visitors- The Mayor welcomed all in attendance and viewing online. 7. Modification to Public Session- No modifications were made. 8. Public Hearing a. Case 2023-RZ-001 Rezone 2460 Lee Hwy [tax parcel 063-025-025A] from R-1 (Single Family Residence District to RO (Residential Office District)- Ordinance 2023-08 Summer Bork reported on a council- initiated request to rezone 2460 Lee Hwy from R-1 to RO. The Planning Commission found that "medical office" was a by - right use within RO zones, but that it had not been defined within the Zoning Ordinance. The Town Manager noted that the Planning Commission wanted the following language added to their affirmative recommendation and a definition for medical office proposed as an amendment to the zoning ordinance a definition of medical office as follows: "as an establishment in which doctors, dentists, or other practitioners licensed by the Commonwealth of Virginia provide health care services to clients, including medical or health-related physical or massage therapy, counseling, diagnoses, or treatment, exclusively on an outpatient basis. "Medical Office(s)" provide outpatient care but do not provide overnight care or serve as a base for an ambulance service." Mr. Reis asked if "counseling" in the definition could be replaced with "mental health". Mr. Rygas stated the zoning ordinance has two uses listed, one for Medical Clinic and one for Medical Office, and the latter does not have a definition. Mr. Rygas recommended not creating different language from the definition of Medical Clinic but refer that matter back to the Planning Commission for clarification. Ms. Bork reported the definition of Medical Clinic was deleted from of the zoning ordinance in 2019; therefore, there is not a definition for Medical Office in the current zoning ordinance. The Town Manager advised that at the next Planning Commission meeting they will review the proposed definition of Medical Office for approval by the Town Council. The Mayor opened and closed the public hearing as there were no speakers. The motion was made by Mr. Dawson and seconded by Mr. Clark to approve Ordinance 2023-08 to include the definition of Medical Office as proposed by the Planning Commission. , Page 2 of 8/ June 6, 2023 Gregory C. Resolution 2023-19 Appropriating Grant Funds The Town Manager stated this grant will fund the purchase of four police vehicles, originally stated to be purchased over the next two years in the CIP. The Mayor opened and closed the public hearing as there were no speakers. The motion was made by Mr. East and seconded by Mr. Radcliffe to approve Resolution 2023-19. Gregory C. East- Aye Jeremy L. Resolution 2023-20 Adopting General Fund Budget for FY 2023-2024 The Town Manager stated the proposed budget will be effective July 1, 2023 through June 30, 2024 and includes a cost of living increase for employees. Tyler Clontz- Aye Michael P. Reis- Aye 10. Resolution 2023-21 Adopting Funds for the Capital Improvement Plan The motion was made by Mr. East and seconded by Mr. Dawson to approve Resolution 2023-21. Resolution 2023-22 Adopting Water Rates for FY 2023-2024 The Town Manager reported an increase of 6% for water rates. Mr. Reis asked if there could be a flat rate increase instead of a percentage increase. The Town Manager stated the percentage increase was based on recommendations from a rate study three years ago but we could look at data to see what a flat rate increase would look like for the following fiscal year. Resolution 2023-23 Adopting Water Fund for FY 2023-2024 The Town Manager noted this budget funds the operation of the filter plant and distribution and repair of waterlines. The motion was made by Mr. Dawson and seconded by Mr. Clark to approve Resolution 2023-23. Gregory C. East- Aye Jeremy L. Clark- Aye Brooks R. Dawson- Aye James A. Radcliffe- Aye G. Resolution 2023-24 Adopting Funds for the Water Fund Capital Improvement Plan The Town Manager stated this budget will continue the replacement of water meters and waterlines. Resolution 2023-25 Adopting Sewer Rates for FY 2023-2024 The Town Manger noted an increase in rates of 7% which covers the operation of the sewer system and our participation in the Regional Authority. Resolution 2023-28 Revising Pay and Classification Plan The Town Manager stated this Classification Plan reflects the 5% increase for town employees. Resolution 2023-29 Cemetery Funds The Town Manager noted the Cemetery Board of Trustees recommended an increase in the cost for cemetery lots and the addition of interment fees along with changes to the cemetery code. Worrell The Town Manager stated the next four resolutions were requested by the Authority on the appointments of members and alternates to the Pepper's Ferry Regional Water Treatment Authority. Council Comments Mr. Dawson stated the landscaping at town properties is looking much better and appreciated the work being put into that activity. Mr. Radcliffe and Mr. Reis thanked staff for their work on the budget. Mayor Collins asked if there are plans for the flower pots at the Train Station. The Town Manager stated she will add the request to the list and mentioned the equipment for cutting along the creek banks should be arriving soon. 27. Manager's Report The Town Manager reported the ladder sculpture removal was successful. She suggested Council cancel the July 0' meeting as the next council meeting falls on that date. She also asked council to consider Monday, July 3`d as an additional holiday for staff.
